Trump indictment - live: Trump defence lawyers gear up for court as co-conspirators unmasked
Donald Trump has been indicted on four charges by a grand jury hearing evidence in special counsel Jack Smith’s investigation into efforts to overturn the 2020 election. The indictment also described six unnamed co-conspirators, now believed identified.
The former president posted the news on Truth Social that he would soon be indicted. It didn’t take long for his campaign to begin fundraising off the news.
This is Mr Trump’s third criminal indictment, his second federal indictment, and his first for his alleged conduct while in office as president.
He has been ordered to make an initial appearance in federal court in Washington on Thursday, while the case has been assigned to US district judge Tanya Chutkan, who was appointed by Barack Obama.
In a brief statement, Mr Smith placed the blame for the violence squarely on Mr Trump’s shoulders, saying the 6 January 2021 riot “was fueled by lies”.
The Trump campaign said he had always followed the law and characterized the indictment as a “persecution” reminiscent of Nazi Germany.
“President Trump will not be deterred by disgraceful and unprecedented political targeting!” it added.

Donald Trump is demanding that his “fake” criminal case over his attempts to overturn the 2020 presidential election be moved out of Washington DC to “unbiased” West Virginia.
In a late-night Truth Social rant on Wednesday, the former president fumed that it is “IMPOSSIBLE to get a fair trial” in the capital and demanded it be relocated to “the politically unbiased nearby State of West Virginia”.
“The latest Fake “case” brought by Crooked Joe Biden & Deranged Jack Smith will hopefully be moved to an impartial Venue, such as the politically unbiased nearby State of West Virginia!” he wrote.
“IMPOSSIBLE to get a fair trial in Washington, D.C., which is over 95% anti-Trump, & for which I have called for a Federal TAKEOVER in order to bring our Capital back to Greatness.
“It is now a high crime embarrassment to our Nation and, indeed, the World. This Indictment is all about Election Interference!!!”

Former Vice President Mike Pence’s testimony and handwritten notes describing private interactions with former president Donald Trump appear to have played a key role in securing charges against the twice-impeached, thrice-indicted ex-president for crimes allegedly committed while attempting to overturn the 2020 presidential election results.
The 45-page indictment against Mr Trump is at least partly based on contemporaneous notes taken by Mr Pence in the days between when he and Mr Trump lost the 2020 election and the January 6 attack on the Capitol that disrupted the final certification of their loss.

Former president Donald Trump and his supporters are reacting to a third indictment against him with a now-familiar playbook: deflecting with unrelated accusations, distracting with misleading claims about the charges, and demonising the prosecution.
Instead of convincing his followers about the seriousness of the charges, Tuesday's indictment is being held up as proof of a conspiracy to take down Mr Trump and a continuation of the effort by Democrats, the media and the so-called deep state to interfere with the nation's elections.
For years Mr Trump has told his supporters that elections can't be trusted and that he is a victim of a corrupt persecution by the government and media.
With that narrative endorsed by conservative news outlets and amplified on social media, it's only natural that many of Trump's supporters will accept it, said Ruth Ben-Ghiat, a New York University historian who studies authoritarian propaganda.

FBI arrests another Capitol rioter

A Donald Trump supporter who took part in the Capitol riots was arrested by the Federal Bureau of Investigation (FBI) yesterday.
The suspect was reportedly a subject of a conspiracy theory on Tucker Carlson's former Fox News show.
Rally Runner was arrested in St Louis, Missouri and faces five federal charges, including obstructing, impeding, and interfering with law enforcement officers during a civil disorder, NBC News reported.
Joseph McBride, a lawyer who represented several 6 January defendants, claimed on Carlson's show that Mr Runner was "clearly a law enforcement officer" and an "agent provocateur" who had dressed up as a Trump supporter to make the former president's fan look bad.

Donald Trump’s latest federal indictment is not the lengthiest of the charging documents that has come his way so far, but it may well be the most profound.
That was the reaction of legal analysts and journalists this week after Jack Smith delivered the Department of Justice’s initial charges against Mr Trump for his efforts to overturn the 2020 election, with much of his conduct in the weeks leading up to and during the January 6 attack going unaddressed in the indictment.
A former deputy assistant attorney general and federal prosecutor who analysed the indictment in an interview with The Independent said that decision was likely deliberate, to ensure that the focus of the case remained on Mr Trump’s efforts and potentially to streamline the path to trial.

Pat Labat, the sheriff for Fulton County where Donald Trump could get indicted for a fourth time this year, said the former president would not receive any special treatment.
Mr Labat said the former president will be fingerprinted and a mugshot will be taken just like a regular person if he's indicted in district attorney Fani Willis' investigation into efforts to overturn Georgia's 2020 election results.

Donald Trump was indicted for a third time on Tuesday on four federal charges stemming from an investigation into his alleged efforts to overturn the 2020 election leading to the January 6 attack on the Capitol.
The indictment marks the second set of federal charges the ex-president is facing and the third indictment overall, since January.
This means Mr Trump will have to appear in federal court, again, to be formally charged with conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, conspiracy against rights and obstruction of, and attempt to obstruct, an official proceeding.
The ex-president is expected to turn himself in at the Elijah Barrett Prettyman Federal Courthouse in Washington DC today at 4pm ET.

Early in his 2016 campaign for the US presidency, Donald Trump told an audience at an Iowa caucus meeting: “I could stand in the middle of Fifth Avenue and shoot somebody, and I wouldn’t lose any voters, OK? It’s, like, incredible.”
Incredible it undoubtedly has been, and he must be hoping that this strange quality of immunity will serve him once again after his indictment on serious federal charges of attempting to defraud the US, tampering with a witness and conspiracy against the rights of citizens. And these are just the latest instalment of alleged offences that will keep Mr Trump, his foolhardy lawyers and the courts busy for months if not years to come.
Unfortunately, for the American people – though not Mr Trump himself – he has been more right than wrong in his observation about getting away with things in recent years. With a total of 71 criminal indictments to his name (so far), he’s never been more popular in Republican circles. The survey, published by The New York Times in partnership with Siena College, was released on Tuesday. Federal prosecutors have asked the judge overseeing the prosecution of Donald Trump, Walt Nauta and Carlos De Oliveira in the Southern District of Florida to hold a hearing that could result in Mr Nauta seeking new legal representation in the case against him.
Special Counsel Jack Smith’s office on Wednesday filed a motion asking Judge Aileen Cannon to schedule what is known as a “Garcia Hearing,” at which Mr Nauta would be informed that he has the right to be represented by a lawyer who does not represent any other party in the case against him.

Co-conspirator 6 is the only individual in the new indictment whose identity still remains a mystery.
The indictment describes them as a “political consultant who helped implement a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding”.
It states that back on 7 December 2020, the political consultant spoke with co-conspirator 1 – identified as Rudy Giuliani – and handed him a list of attorneys in Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania, and Wisconsin who he believed could help with the fake elector scheme in their respective states.
While this person could have been a number of people in Mr Trump’s orbit at the time, The New York Times zeroes in on a particular clue in the indictment in that an email sent in December 2020 matches the above description of an interaction with Mr Giuliani.
That email was sent on 7 December 2020 by Boris Epshteyn, a strategic adviser to the Trump 2020 campaign, and had the subject line “Attorneys for Electors Memo”.
Per the Times, it reads: “Dear Mayor, As discussed, below are the attorneys I would recommend for the memo on choosing electors,” and then goes on to identify lawyers in the seven states listed above on page 57 of the indictment.
Todd Blanche, a lawyer for Mr Epshteyn, declined to comment when contacted by the Times, as did Peter Carr, a spokesman for the special counsel Jack Smith.
