Rust trial – live: Armourer who handed gun to Alec Baldwin found guilty over fatal movie set shooting

A jury has found Hannah Gutierrez-Reed guilty of involuntary manslaughter in connection to the accidental 2021 shooting death of cinematographer Halyna Hutchins.

The armourer who gave Alec Baldwin a gun on the set of the doomed movie Rust did not take the stand in her own defence during the trial, which lasted nearly two weeks.

The jury deliberated for 2.5 hours before delivering the verdict on Wednesday. She was found not guilty of evidence tampering.

Gutierrez-Reed did not react as the verdicts were read out, but appeared to be in disbelief when the judge ordered she be taken into custody.

Loved ones and supporters gathered in the Santa Fe courtroom were visibly upset. Her sentencing was set for April, but an exact date is to be determined. She faces up to 18 months in prison.

Actor and producer Alec Baldwin is also facing involuntary manslaughter charges related to the shooting. His trial will begin on 9 July.

Prosecutors said Gutierrez-Reed is to blame for unwittingly bringing live ammunition on set and that she flouted basic safety protocols for weapons handling.

The defence said she was unfairly scapegoated for problems beyond her control, including Mr Baldwin’s handling of the weapons.

Hannah Gutierrez-Reed remained emotionless as she was convicted of involuntary manslaghter.

Her loved ones, meanwhile, cried in the public gallery. Following the verdict the judge ordered that the armourer be remanded in custody, with a sentence date to be set later.

What happened to Halyna Hutchins?

On the day of the shooting, Baldwin was rehearsing a scene in which he was required to draw his weapon and aim it toward the camera.

Ms Gutierrez-Reed had prepared a trio of guns for use in the scene, including two guns that could not fire rounds, and a fully-operational replica of a Colt 45 revolver.

At some point during his draw and explanation, the revolver fired. The bullet struck Halyna Hutchins in the chest, exited her body, and then hit Mr Souza, who was behind her.

First responders transported Hutchins to a hospital in Albuquerque, New Mexico, close to where the film was being shot. She was pronounced dead later that same day. Mr Souza survived.

It was later discovered that a live round had been loaded into the pistol Baldwin used on set that day.

Gutierrez-Reed appeared to be in disbelief as she removed her necklace and blew a kiss to her family as she was escorted out of the room by two deputies.

The role of Alec Baldwin, who served as the star and producer of the “Rust” movie, did not factor into the decision to convict armourer Hannah Gutierrez-Reed of involuntary manslaughter, a juror in the case has said.

Ms Gutierrez-Reed was found guilty of one charge on Wednesday, though a separate charge of tampering with evidence was dismissed.

During the trial, it was announced that Mr Baldwin’s trial – in which he is also charged with involuntary manslaughter – will begin on 9 July.

Speaking outside court following the verdict, juror Alberto Sanchez was asked if Mr Baldwin or other members of the film’s production team had played a part in the deliberations.

“They’re gonna have their day [in court] so we really didn’t take that into consideration, it wasn’t part of it,” Mr Sanchez said.

Juror Alberto Sanchez said that he believed the decision to find Hannah Gutierrez-Reed guilty on the charge of involuntary manslaughter was “fair”.

Speaking outside the court following the verdict, Mr Sanchez explained how the jury had reached its verdict in the trial in less than three hours.

“There were a lot of safety issues, she could have paused, stopped and cleared it up,” he said. “[She] never did the safety checks...if you’d have done that this would not have happened.”

Asked how he felt about the decision he replied: “I think it was fair and... someone died, I mean, you gotta take responsibility, especially when you’re handling weapons and you’re in charge of those, that’s your job.

“And lack of experience or whatver you want to call it, you took the job.”

There are four possible verdicts in the first count of involuntary manslaughter.

Judge Mary Marlowe Sommer said Gutierrez could be found guilty of involuntary manslaughter, not guilty of involuntary manslaughter, guilty of negligent use of a firearm or not guilty of negligent use of a firearm.

A lesser, misdemeanor charge of negligent use of a firearm is included in the first count of involuntary manslaughter.

The jurors will only deliberate on the negligent use of a firearm charge if they find Gutierrez not guilty of involuntary manslaughter, the judge said during jury instructions.

A second charge against Gutierrez-Reed of evidence tampering stems from accusations that she handed a small bag of possible narcotics to another crew member after the shooting to avoid detection.

The felony charges against Gutierrez-Reed carry a possible sentence of up to three years in prison.

Morrissey then adds that Gutierrez-Reed didn’t know there were live rounds on set because of her own negligence, recklessness, and willful disregard for the safety of other people.

“It is shocking for Mr. Bowles to come up to this podium and say it wasn’t foreseeable that Alec Baldwin would go off…”

“It is her job to say to an A-list actor, ‘hey, you can’t behave that way with those firearms.’ That is her job. That is what they pay her for. That is the job that she applied for. That is the job that she accepted.”

He also pointed out that OSHA made an official determination that this was a production and management issue.

Proceedings will shortly begin in the high-profile trial of Hannah Gutierrez-Reed, the armourer on the set of the film “Rust”, who faces involuntary manslaughter charges in the shooting death of cinematographer Halyna Hutchins.

There was a lengthy delay this morning as both sides argued over closing arguments and jury instructions.

The State had concern over the defence team’s closing argument language they plan to use about the improper intubation of Halyna Hutchins, NBC’s Dana Griffin reported from the courtroom.

This portion of the trial was not being live streamed.

The State wanted to prevent the jury from hearing that improper intubation could have been a cause of her death. A doctor testified that the cause of death was the gunshot.

There was also an issue over the jury instructions.

The State wanted to mention that jurors have to be unanimous on the involuntary manslaughter charge but not unanimous on the three alternative theories.

The defence objected and say the jurors have to be unanimous on the theory.

The judge ruled that the jury instructions as they stand are sufficiently correct.

“We do not need anonymity on the theory.”

Court is taking a break before the jury is brought in.

The defence team is expected to rest this morning followed by closing arguments.

The jury could have the case as soon as this afternoon.

Firearms expert Frank Louis Blair Koucky III – who was testifying for the defence on Tuesday –  shocked the court when he pointed an unloaded revolver in the judge’s direction to demonstrate it was unloaded.

Seconds earlier, as he began displaying a firearm he’d brought for demonstration purposes, the judge informed him to make sure the weapons were unloaded.

“Everybody’s nervous because you have not demonstrated to us they are unloaded,” District Judge Mary Marlowe Sommer said.

“So before you start showing us the weapons, make sure they’re unloaded, including that one you just touched.”

He then pointed the gun in the direction of the judge, drawing gasps from the courtroom.

Ammunition supplier testified Monday that he only provided inert dummy rounds to Rust film crew

Albuquerque-based movie firearms and ammunition supplier Seth Kenney testified at trial Monday that he only provided inert dummy rounds to the Rust film crew, though he also was handling live rounds from another production at that time.

Mr Kenney told a jury he cleaned and repackaged ammunition to “Rust” that was previously supplied to a production in Texas, handing off a box of 50 inert dummy rounds containing no gunpower to the “Rust” props supervisor on 12 October 2021.

He said also said he scrubbed the exterior of the rounds and cleaned out residue inside in each of them to ensure the telltale rattle of a metal pellet inside dummy rounds could be heard for safety purposes.

The outcome of trial may hinge on testimony about the source of six live rounds discovered on set — including the one from Mr Baldwin’s gun. Live ammunition is expressly prohibited on movie sets by the industry and union guidelines.
