Oregon Supreme Court reinstates governor’s coronavirus restrictions after they were tossed by local judge

Oregon’s coronavirus restrictions remained in place on Tuesday after the state supreme court blocked the ruling of a local judge, who tossed the governor’s emergency guidelines over logistical failures earlier this week.

Baker County Circuit Judge Matthew Shirtcliff ruled that Gov. Kate Brown overstepped when she failed to seek Legislature’s approval before extending her stay-at-home order beyond a 28-day limit. The state has been following emergency guidelines since March 8 in a bid to slow the fast-spreading COVID-19.

Brown has issued multiple executive orders since then, including the closure of all schools, nonessential businesses and a ban on dine-in service at restaurants and bars.

The state’s top court however, blocked Shirtcliff’s decision late Monday pending review by all the high court justices. His opinion, issued earlier in the day, was in response to a lawsuit filed this month by 10 churches across Oregon, which argued the state’s social-distancing rules were unconstitutional.

The guidelines have resulted in drive-in church services, with worshipers sitting in parking lots for weekly mass.

Shirtcliff wrote in his seven-page ruling that Brown’s directives caused more damage to Oregon residents than the dangers presented by the coronavirus. He also noted that other essential businesses had been allowed to remain open even with large numbers of people present while relying on masks, social distancing and other measures to protect the public.

In a statement late Monday, Brown praised the Supreme Court action.

“From the beginning of this crisis, I have worked within my authority, using science and data as my guide, heeding the advice of medical experts. This strategy has saved lives and protected Oregonians from the worst of the COVID-19 pandemic," she said.

Earlier this month, Brown extended her emergency order another 60 days until July 6, but nearly every Oregon county has received the state’s approval to begin loosening those restrictions last week.
