Motion filed in Baldwin case alleges prosecutors withheld info from grand jury

Mar. 14—Attorneys for actor and producer Alec Baldwin filed a motion Thursday seeking dismissal of his involuntary manslaughter charge and accusing prosecutors of misconduct.

The charge stems from the Oct. 21, 2021, shooting death of cinematographer Halyna Hutchins, who was struck by a bullet from a .45 Colt revolver Baldwin was holding on the Rust movie set at Bonanza Creek Ranch south of Santa Fe.

Baldwin's legal team argues in the motion the case should be thrown out in part because special prosecutors breached their duty to provide grand jurors who indicted Baldwin with exculpatory information.

Exculpatory evidence is generally considered favorable to the defendant.

Baldwin — who has said he didn't pull the gun's trigger — has entered a plea of not guilty and is set to stand trial in July.

"The State prosecutors have engaged in this misconduct and publicly dragged Baldwin through the cesspool created by their improprieties without any regard for the fact that serious criminal charges have been hanging over his head for two and a half years," attorney Luke Nikas wrote in the motion.

"Enough is enough. This is an abuse of the system, and an abuse of an innocent person whose rights have been trampled to the extreme," he continued. "The Court should dismiss the indictment."
