Trump news today: Jack Smith seeks protective order over Truth Social ‘threat’

Federal prosecutors in Donald Trump’s latest indictment are seeking a protective order after he posted a perceived threat on Truth Social.

A day after being arrested and pleading not guilty to four federal charges for allegedly conspiring to overturn the 2020 presidential election, Mr Trump wrote on his social media site: “IF YOU GO AFTER ME, I’M COMING AFTER YOU!”

The Department of Justice cited that post in asking District Court Judge Tanya Chutkan for a protective order that would limit what discovery evidence Mr Trump and his legal team can share publicly.

Special counsel Jack Smith’s team said such an order could help prevent a “harmful chilling effect on witnesses”.

The Trump campaign then issued a statement insisting his post was not a threat of revenge but rather “political speech”.

“The Truth post cited is the definition of political speech, and was in response to the RINO, China-loving, dishonest special interest groups and Super PACs, like the ones funded by the Koch brothers and the Club for No Growth,” the campaign said.

Judge Chutkan is giving Mr Trump and his attorneys until Monday to respond to the protective order request.

Trump demands Judge Tanya Chutkan be removed from election case after ruling against him

Donald Trump has called for the judge in his most recent federal indictment to be removed from the case after she issued a ruling against him.

The ex-president launched his attack on District Court Judge Tanya Chutkan on Sunday morning, days after he appeared before her in court to plead not guilty to four federal charges stemming from a Department of Justice investigation into his alleged efforts to overturn the 2020 election and the subsequent January 6 attack on the Capitol.

Trump looking to play First Amendment card

16:00 , Ariana Baio

Donald Trump and his attorneys are looking to use the First Amendment as a defence against the indictment which charged the ex-president with four federal charges.

Last week, Mr Trump’s attorney went on several network news shows to explain that Mr Trump’s words after the 2020 election and leading up to the January 6 insurrection were protected by the First Amendment right to free speech and therefore cannot be illegal.

On Truth Social, Mr Trump wrote: “THERE IS NO WAY I CAN GET A FAIR TRIAL WITH THE JUDGE “ASSIGNED” TO THE RIDICULOUS FREEDOM OF SPEECH/FAIR ELECTIONS CASE. EVERYBODY KNOWS THIS, AND SO DOES SHE! WE WILL BE IMMEDIATELY ASKING FOR RECUSAL OF THIS JUDGE ON VERY POWERFUL GROUNDS, AND LIKEWISE FOR VENUE CHANGE, OUT IF D.C.”

In the indictment, prosecutors acknowledged that Mr Trump had the right to say whatever he wanted but his actions were allegedly unlawful as he tried to use several people, including the vice president, to exercise power they were not authorised to in order to change results.

Trump rants about indictment on Truth Social claiming it is a ‘Bidin opponent case’

Sunday morning Donald Trump took to Truth Social to rant about the most recent federal indictment against him which he claims is an act of political retaliation.

“DERANGED JACK SMITH AND OUR HIGHLY PARTISAN, AND VERY CORRUPT, DEPARTMENT OF INJUSTICE, COULD HAVE BROUGHT THIS BIDIN “OPPONENT” CASE YEARS AGO, BUT CHOSE TO WAIT AND BRING IT RIGHT IN THE MIDDLE OF MY ELECTION CAMPAIGN,” Mr Trump wrote.

The ex-president believes President Joe Biden encouraged the indictment which charged Mr Trump with four federal charges related to his alleged efforts to overturn the 2020 election.

Special Counsel Jack Smith in the Department of Justice (DoJ) has been investigating Mr Trump for his actions that led up to the January 6 insurrection.

Trump goes on erratic tangent about washing his hair

14:30 , Ariana Baio

Donald Trump gave a speech in South Carolina on Saturday night that included a long-winded tangent about washing his “gorgeous head of hair” and water pressure.

The ex-president spoke at the Silver Elephant Gala where he spoke about his recent federal indictment, the economy and jobs. But while speaking about jobs under the Biden administration Mr Trump used how he washes his hair to describe the difference in his administration’s regulations.

“You know I have this gorgeous head of hair. When I take a shower I want water to pour down on me. When you go into these new homes the water drips down slowly,” Mr Trump said.

“Slowly. You have suds, beautiful, nice, wonderful suds – lot of money, Procter and Gamble, all of that crap they say is good. Probably cost them about two cents and they sell it for $10.”

He added: “But it takes you 10 minutes to wash your hair. You know what you do? You just stay in the shower about 10 times longer than you would’ve. It’s the same. You probably use more water. I broke all of that up.”

Democrats are calling for Trump’s trial to be televised

13:30 , Ariana Baio

Federal court proceedings are rarely televised.

But Democrats are pushing for the trial to be televised; they wrote a letter on Thursday to Judge Roslynn Mauskopf, the director of the Administrative Office of the US Courts.

The letter, led by Rep Adam Schiff and signed by 37 other Democratic lawmakers, pressed that the trial be shown “unfiltered, to the public.”

The letter asks for the trial to be broadcasted, as it “ensures timely access to accurate and reliable information,” emphasising “the extraordinary national importance to our democratic institutions and the need for transparency.”

“Given the historic nature of the charges brought forth in these cases, it is hard to imagine a more powerful circumstance for televised proceedings,” the Democrats wrote. “If the public is to fully accept the outcome, it will be vitally important for it to witness, as directly as possible, how the trials are conducted, the strength of the evidence adduced and the credibility of witnesses.”

Those closest to Trump could be called to testify

Several former and current aides to Donald Trump could soon be called to testify against their boss as the ex-president faces three criminal indictments.

According to a report from The Washington Post several of Mr Trump’s current advisers are named in one of three indictments or have been interviewed by prosecutors – all while working on his 2024 campaign.

This includes his top adviser, senior communications aide and other staffers, according to The Post.

Mr Trump’s former personal aide, Walt Nauta, was recently named as a co-defendant in the classified documents probe. Carlos De Oliveira, a Mar-a-Lago property manager, was also named as a co-defendant.

In the January 6th and 2020 election conspiracy probe, six unnamed co-defendants were named alongside Mr Trump – most likely those closest to the former president while he was in office.

Nikki Haley speaks about Trump indictment

Ex-South Carolina governor and 2024 presidential candidate Nikki Haley spoke about Donald Trump’s indictment on Thursday, two days after Mr Trump was indicted.

“Unlike the other candidates, I didn’t rush out with a statement yesterday on Trump’s indictment for one simple reason — like most Americans, I’m tired of commenting on every Trump drama. I’ve lost track of whether this indictment is the third or fourth or the fifth,” Ms Haley said on Good Morning New Hampshire with Jack Heath.

She added: We should be focusing on how to stop China. We should be focusing on how to close the border. We need to be reversing Bidenomics. Putting a 77-year-old former president in prison doesn’t do any of that. We’ve got to move on already.”

Explained: Why Trump is charged under a civil rights law used to prosecute KKK terror

01:00 , Ariana Baio

Mr Trump has been charged with three criminal conspiracies – including a conspiracy to deprive Americans’ right to vote and to have their votes counted, a statute rooted in bedrock civil rights protections enacted in the brutal aftermath of the US Civil War.

A crime of conspiracy against rights invokes Section 241 of Title 18 of US Code, among criminal codes that came from the Enforcement Acts, also known as the Ku Klux Klan Acts. Those laws were designed to protect Americans’ newly enshrined rights under the 13th, 14th and 15th Amendments – allowing the federal government to protect the rights of newly enfranchised Black people to vote, hold office, serve on juries and receive equal protection under the law against white supremacist terror.

ICYMI: DoJ and Trump attorneys go back-and-forth over proposed protective order

23:00 , Ariana Baio

Prosecutors in the Department of Justice and Donald Trump’s attorneys have gone back and forth with each other in filings sent to Judge Tanya Chutkan over a proposed protective order response.

The requested order, proposed by federal prosecutors, was filed on Friday and asks Judge Chutkan to prevent Mr Trump and his attorneys from revealing specific information about the January 6th and alleged election conspiracy indictment publicly.

Judge Chutkan initially asked Mr Trump’s attorneys to respond by Monday at 5pm ET but the lawyers responded asking for a delay until Wednesday.

The DoJ filed a statement to Judge Chutkan saying Mr Trump’s motion “should be denied.”

“The Government wants to provide discovery to the defendant. By his motion, the defendant seeks to delay that process,” the statement reads.

Former vice president and 2024 candidate Mike Pence is capitalising on Donald Trump’s recent federal indictment by drawing positive attention to his own campaign with joking merchandise and snapping back at hecklers.

While on the campaign trail in New Hampshire this past week, Mr Pence was confronted by a group of Mr Trump’s supporters who called him a “sellout” and “traitor” for refusing to falsely and unlawfully certify the 2020 election results in Mr Trump’s favor.

“Why didn’t you uphold the Constitution?” one protester shouted at Mr Pence on Friday.

Mr Pence notoriously refused to engage in Mr Trump’s alleged efforts to overturn the 2020 election which ultimately made him a target during the Capitol riots.

The ex-vice president calmly turned to the group of Trump supporters and responded, “I upheld the constitution. Read it.”

Federal prosecutors accused Donald Trump and his attorneys of trying to delay the process in his January 6 case by filing a motion to delay the time they are given to respond.

“The Government wants to provide discovery to the defendant. By his motion, the defendant seeks to delay that process,” the filing from the Department of Justice on Saturday reads.

Prosecutors urged Judge Tanya Chutkan to deny Mr Trump’s motion to delay the date of response.

Mr Trump’s attorneys asked the judge to move the date from Monday until Wednesday to give them more time to consider the proposed protective order.

Frederick Francis Goltz, a man who advocated for a mass shooting of poll workers and threatened two Arizona officials and their children, has been sentenced to 3 1/2 years in federal prison.

Prosecutors said court documents showed that Mr Goltz threatened several people including a lawyer with the Maricopa County Attorney’s Office and a Maricopa County elections official, on far-right social media platforms.

In plea papers, Goltz admitted that on 21 November 2022, he posted the lawyer’s name, home address and telephone number on social media, writing: “It would be a shame if someone got to this children.” On the same date, in response to another post referring to other Maricopa County officials, he wrote: “Someone needs to get these people AND their children. The children are the most important message to send.”

Trump attorneys ask judge to extend protective order response deadline

Donald Trump’s attorneys answered Judge Tanya Chutkan’s request to respond to the protective order that prosecutors in the Department of Justice requested and asked Judge Chutkan for an extension.

Judge Chutkan initially told Mr Trump and his attorneys that he had until Monday to respond with any disagreements or changes to the protective order.

But Mr Trump’s attorneys filed a request to extend that until Wednesday, 10 August.

Lawyers for the ex-president said it would give them more time to review the proposed order and give feedback as they believe it is too complex to agree to upfront.

“Discovery in this case will be extensive and likely present numerous complex issues. For that reason, it is essential to structure the parties’ discussion in a methodical and, ideally, cooperative manner,” Mr Trump’s attorney wrote.

They went on to call the restrictions laid out by the DoJ “wholly unproductive” and “undermine the potential for party-driven resolutions.”

Will Trump’s history of lies finally catch up to him?

Friday 4 August 2023 15:50 , Oliver O'Connell

A persistent lie that the 2020 election was stolen from him fuelled violence at the US Capitol on 6 January 2021, sustained partisan investigations intended to reverse the outcomes in states he lost, inspired Republican-led legislation in nearly every state to change how elections are run, and has formed the basis of Mr Trump’s 2024 campaign.

Did he believe the “truth” of his claims? And how often was he told, by both his advisers and White House officials, that he was wrong?

These are questions that prosecutors are likely considering as US Department of Justice special counsel Jack Smith and his team prosecute the former president, but they won’t need to establish that he was aware that he was spreading misinformation to charge him for crimes allegedly committed to throw out millions of Americans’ votes and remain in power.

Years of evidence, however, suggests that he knew what he was saying was false, or that he should have known he was not telling the truth when he waged his assault on an election he lost to Joe Biden.

How historic day of third arraignment unfolded

Friday 4 August 2023 15:30 , Oliver O'Connell

America had another historic day on Thursday 3 August as former president Donald Trump turned himself in to face charges related to his alleged conspiring to overturn the 2020 presidential election as part of a desperate bid to defy the will of voters and remain at the head of the US government.

Thirty-one months after a mob of his supporters stormed the US Capitol to try to stop the certification of the 2020 election, Mr Trump sat in the E Barrett Prettyman Courthouse nearby to face criminal charges.

At his arraignment, Mr Trump pleaded not guilty to all four federal charges.

The ex-president was indicted on the federal charges on Tuesday 1 August following an investigation led by Justice Department special counsel Jack Smith’s office.

The arraignment marked Mr Trump’s third criminal indictment and second federal indictment as his legal troubles continue to mount at a time when he is pursuing his third run for the White House.

Trump starts his morning with (you guessed it) a Truth Social rant

Friday 4 August 2023 14:45 , Rachel Sharp

Donald Trump started his morning on Friday with a characteristic Truth Social rant – hitting out at “Crooked Joe”, “election interference” and Fox & Friends.

“CRAZY! My political opponent has hit me with a barrage of weak lawsuits, including D.A., A.G., and others, which require massive amounts of my time & money to adjudicate. Resources that would have gone into Ads and Rallies, will now have to be spent fighting these Radical Left Thugs in numerous courts throughout the Country. I am leading in all Polls, including against Crooked Joe, but this is not a level playing field. It is Election Interference, & the Supreme Court must intercede. MAGA!” he wrote.

In a follow-up post, he took aim at Fox & Friends: “Why is it that Fox & Friends refuses to put up all of the polls where I am beating Biden, and DeSanctimonious is getting clobbered? He’s also down to me by 40 plus points, and not coming back. No wonder their ratings are way down!!!”

The twice-impeached, now-thrice-indicted ex-president’s appearance in criminal court – his third since April – comes just two days after a Washington DC grand jury charged him with three criminal conspiracies and obstruction in connection with his attempts to overturn the results of the 2020 presidential election.

She added: “I am told that the former president, one thing that irked him particularly, was during that hearing today that lasted about 27 minutes, was when the magistrate judge referred to him as simply ‘Mr Trump.’”
