Why are Kevin Costner and his wife divorcing?

Baumgartner filed for divorce in May citing "irreconcilable differences." While neither Costner nor Baumgartner have publicly revealed the exact reasons behind their split, sources told PEOPLE it was a long time coming for the handbag designer, who struggled with Costner's busy work schedule.

"His absence has been very hard for her," an insider said. "Christine doesn't want him to throw himself into another project. He has been obsessed with filming Horizon since last year. She wasn't happy about it."

A source close to Costner said he was "surprised, but not shocked" by the breakup because he knew Baumgartner had been unhappy, adding, "It was not anything that he wanted or sought, and if he could change the situation, he would."

Questions of fidelity have been raised on both sides since news of the split broke, but no cheating rumors have been substantiated.

Costner’s former tenant Daniel Starr, for instance, shut down claims that he had a romantic relationship with the Field of Dreams actor’s estranged wife at any point. “They’re going through a divorce. They have kids, I feel really badly,” Starr told TMZ in June. “I hope that they can peacefully resolve that.”

Meantime, Baumgartner's legal team alluded to the possibility of an "extramarital affair" on Costner's end when they requested "all statements, receipts, invoices, cancelled checks" and documents related to expenses paid by Costner for himself or that of a mistress, according to court documents obtained by Fox News Digital.

Costner's team, led by famous celebrity divorce lawyer Laura Wasser, shot back that the demand was "only [for] purposes of harassment."

"Respondent has no responsive documents for ‘extramarital romantic relationships' in which he engaged because he engaged in none," the docs stated, per Fox News Digital.

Do Kevin Costner and Christine Baumgartner have a prenup?

Yes. Costner has been down this road before—his 1994 divorce from Cindy Silva cost him an estimated $80 million—and this time has a prenup, or legally speaking, a premarital agreement.

Among other things, the agreement required that Baumgartner vacate the $145 million Santa Barbara home she lived in with Costner and their three children before the first of June—within 30 days of her filing for divorce—which she didn't do until the end of July, after a judge ordered her to vacate. It also provided Baumgartner with a $1.5 million payout from Costner.

There have been suggestions that Baumgartner will contest the prenup (which would mean forfeiting her $1.5 million lump sum). In court documents filed by Costner's legal team on Aug. 10 (via PEOPLE), Costner's lawyers refuted claims from her side that she "felt pressured to sign the agreement because of the circumstances surrounding its execution" and "didn't fully understand it."

"This, after she previously admitted she entered the agreement under her own "free will," the lawyers wrote, according to the outlet.

Baumgartner did indeed challenge the prenup in court, and it didn't end as well for as she would have hoped. She reportedly only got marginally more than the prenup stipulated in their split, along with some embarrassment over testimony like "luxury" being in her and Costner's children's "blood."

How much does Kevin Costner pay in child support?

In court documents filed by Baumgartner's attorneys and obtained by PEOPLE in June, Baumgartner asked for $248,000 a month in child support, alleging in the filing that the figure "is less than the amount needed to maintain the children in their accustomed lifestyle." Costner responded that he could not afford that amount because his 2023 income would diminish following his exit from Yellowstone.

An interim ruling in July ordered Costner to pay Baumgartner $129,755 per month for their children’s care, plus $200,000 in attorneys’ fees and $100,000 in forensic costs.

But after a two-day hearing that began Aug. 31, 2023, the court ruled in favor of Costner, ordering him to pay $63,209 per month for their three children—just about a third of the $175,057 per month Baumgartner was requesting at the time of the case.

“Because the children fly on private aircraft to go on luxury vacations when they are with their father, the Family Code dictates that Kevin should pay sufficient child support to Christine so that the children can go on comparable vacations when they are with her. This is true even if the child support payments also improve Christine’s lifestyle,” Baumgartner’s lawyers wrote in a brief filed on Aug. 30. “In this case, the guideline child support requested by Christine of $175,057 per month will not be sufficient to replicate Kevin’s lifestyle, but it will be sufficient to allow her to provide a lifestyle for the children which is relatively comparable."

Costner spoke out about his split for the first time (at least since his initial statement, which was delivered via a representative) on Sept. 1, 2023, after winning the child-support case.

“This is a horrible place to be, but this is where we’re at,” he told Access Hollywood outside of a Los Angeles court room. “It feels so bad. We’re talking about somebody I love on the other side. I just can’t.”
