Jamie Foxx has been sued for an alleged sexual assault in a new lawsuit, as reported by the BBC. It claims the Django Unchained actor, real name Eric Marlon Bishop, assaulted a woman at a restaurant in New York City in 2015.

The woman, identified in the lawsuit as Jane Doe, claims the star groped her after she asked to have a photo with him at around 1am on August 26, 2015, at Catch NYC.

Following the alleged incident, she is suing Foxx for damages citing "sexual assault, abuse, assault and battery".

Digital Spy has contacted representatives for Jamie Foxx for comment.

The lawsuit claims that Doe was sitting at a table next to Foxx at the restaurant when she asked for a photo and that the actor appeared intoxicated.

He is said to have agreed to a photo, allegedly saying "Sure, baby, anything for you," before it claims he told the woman she had a "supermodel body" and smelled "so good".

The lawsuit says he touched her breasts and put his hands in Doe's underwear without her consent in a secluded part of the restaurant, after which her friend came looking for her.

The court documents continue that as a result, Doe "suffered and continues to suffer severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder and other physical and emotional damage".

Doe is also seeking damages from the restaurant owner Mark Birnbaum, who she claims was seated with Foxx before the alleged assault occurred.

It is claimed in the lawsuit that Birnbaum and the restaurant's employees, including a security guard, witnessed the incident but did not intervene.

The lawsuit is filed under the New York Adult Survivors Act, which allows alleged victims of sex crimes to sue.
