Can you go to jail for cheating on your spouse in Texas? Here’s what the law says

Cheating on your spouse is not illegal in Texas. It takes more than kissing or touching someone other than your spouse for it to be considered adultery, according to state law.

A person must show Texas courts convincing evidence — suspicious behavior, inexplicable absences, or sudden changes in affection, to prove adultery throughout a marriage. Adultery won’t be treated as a crime, but the court will consider it as a violation of certain civil laws.

Since adultery isn’t considered a crime a spouse cannot sue for it. However, it could influence the divorce court’s decision on property division, child custody, alimony, and community assets.

Infidelity is a common problem marriage and family therapists have to sort out. While most couples disapprove of stepping out on their marriages, surveys have found 15% of women and 25% of men have cheated on their spouses. If you include emotional and sexual intimacies without sex, then the percentages spike by 20%.

According to relationship advice website, datingadvisor.com, three Texas cities topped the list of the most unfaithful cities in the United States in 2022. Dallas came out as No. 1, Fort Worth at No. 2 and Houston at No. 3.

The site analyzed 200 of the largest metro areas based on four factors to determine the most unfaithful cities in the nation: relationship satisfaction, life satisfaction, infidelity intent, and affair actions. Here are the states that made the list.
