El Paso father sought in Amber Alert for missing son charged with aggravated kidnapping

An El Paso father accused of kidnapping his son is facing multiple charges including aggravated kidnapping with a deadly weapon and assaulting a family member, jail records show.

Miguel Angel Montoya, 30, was arrested late Thursday night after an hours-long SWAT situation at an El Paso motel in connection with the alleged kidnapping of his 2-year-old son, Kenji Montoya, which led police to issue a statewide Amber Alert.

Montoya was arrested on suspicion of aggravated kidnapping with a deadly weapon, assault of a family member by impeding breath, and unauthorized use of a motor vehicle, jail records show.

He was booked into the El Paso County Jail Friday, March 15. He is being held on a bond totaling $235,000.

Montoya pulls out sword, threatens to kill several people

The incident began when Montoya’s ex-girlfriend arrived at her ex-husband’s apartment about 8:45 p.m. March 13 in the 7200 block of North Loop Drive.

Montoya was hiding in the apartment and “popped out of nowhere” while the ex-girlfriend was in the apartment, a complaint affidavit states.

He allegedly told her, “You’re a hard (expletive) to find,” the affidavit alleges. He allegedly pulled out a sword and told her she was lucky to have arrived at the apartment first because he would have killed her ex-husband if he had got to the apartment before her.

Montoya told her they were going to pick up her niece from her sister’s house. He allegedly said he wanted to pick up the niece to use as bait to pick up his daughter from a previous relationship, the affidavit states.

The ex-girlfriend told police the daughter and the mother of the daughter had filed a sexual assault report against Montoya.

Montoya allegedly told the ex-girlfriend that the daughter had ruined his life and he wanted her dead, the affidavit states.

He told the ex-girlfriend that if she did not do what he told her he would kill her and her son, the affidavit states.

Montoya started to unplug cameras in the apartment. He took the ex-girlfriend’s cell phone and changed the passcode.

He forced her to drive the Dodge Journey and he placed Kenji Montoya in a car seat in the backseat of the car.

Montoya got into the front seat with the sword. He allegedly told the ex-friend he had a gun. However, the ex-girlfriend told police she never saw the gun, the affidavit states.

As they were driving, Miguel Montoya gave her a set of rules to follow or he would kill her, the affidavit states. The rules were to drive the speed limit, not to drive reckless, and if anyone called not to act weird.

The ex-girlfriend called her sister, under Montoya’s orders, and told her she was on her way to pick up the niece, the affidavit states. Montoya made her tell the sister to have the niece ready and to come out alone because she was in a hurry.

They then parked in the parking lot of an Applebees restaurant and waited. Montoya then began texting the ex-girlfriend’s sister pretending to be the ex-girlfriend.

Miguel Montoya allegedly began to use cocaine and stated he wanted to kill them for ruining his life, the affidavit states.

They drove to the sister’s house. Montoya got into the back seat with his son as they drove to the house.

The ex-girlfriend called her sister and told her to send out the niece. The ex-girlfriend began honking the car’s horn to get the attention of her sister and niece.

She tried to jump out of the car but Montoya pulled her by the hair back inside the car, the affidavit states.

Montoya got into the driver’s seat and fled with Kenji Montoya still in the back seat, the affidavit states.

The ex-girlfriend called police to report the kidnapping.

Search for Miguel Montoya ends with boy found safe

El Paso police arrived at the sister's home and began investigating the kidnapping.

An Amber Alert was issued about 6:30 a.m. March 14.

El Paso Police Department officers, U.S. Border Patrol agents, U.S. Customs and Border Protection officers and Texas Department of Public Safety troopers conducted a large manhunt searching for Miguel Montoya and the boy. The search included law enforcement officers monitoring border crossings into Mexico and the New Mexico state line, officials said.

Police found the Dodge Journey late Thursday morning and believed Miguel Montoya had changed vehicles to a red 2008 Chevrolet Cobalt with Texas license plate TRH6179.

Police urged community members to report any sighting of Miguel Montoya, his son, or the vehicle.

The manhunt ended late Thursday night after Miguel Montoya and his son were found at a Studio 6 motel in the 1300 block of Lomaland Drive, officials said. After an hours-long standoff with the El Paso Police Department's SWAT team, Montoya was taken into custody and the boy was safely recovered, officials said.

No further information has been released.

Ex-girlfriend alleges Miguel Montoya sexually assaulted her in February

The ex-girlfriend filed a report with the El Paso Police Department Feb. 21 claiming Montoya had raped her when they went out on a date, a complaint affidavit states.

She and Miguel Montoya had a date planned and he asked her to wear lingerie to which she agreed, the affidavit states. The then-couple went for drinks when Miguel Montoya allegedly began asking her to perform sexual acts on him.

She denied his requests and he became angry and told her, "Oh you don't care? Guess I won't care what I do to you," the affidavit states.

Montoya allegedly sexually assaulted her Feb. 10. She told Montoya that he was hurting her and he replied, "shut the (expletive) up," the affidavit states. Montoya allegedly grabbed her by the throat causing her to lose her breath and then pushed her face into a pillow, not allowing her to breath.

Lengthy criminal history with families violence arrests

Montoya has a lengthy criminal record, including family violence charges, jail and court records show.

He was arrested in March 2017 on charge of assault of a family member by impeding breath, jail records show. He pleaded guilty in June 2017 and was sentenced to seven years of probation.

He was also arrested in 2017 on suspicion of sexual assault, but the case was declined, jail records show. Court records do not state why the case was declined.

In 2012, he was arrested on suspicion of aggravated assault with a deadly weapon and assault causing bodily injury involving family violence, jail records show.

He was sentenced to seven years of probation on the aggravated assault with a deadly weapon charge, and one year of probation on the family violence charge, court records show.

As part of his probation, he was ordered to participate in family violence counseling.

He violated his probation after being arrested in 2014 for possession of marijuana, jail records show. He was sentenced to 80 days in jail on the probation violation and 11 days in jail on a possession charge, court records show.
