SHEBOYGAN — The Alabama Supreme Court recently ruled frozen embryos are children, a decision that halted many in vitro fertilization providers in the state and left hopeful parents scrambling to prepare for the ruling’s potential widespread effects.

The ruling was in relation to a wrongful death case and ruled embryos created through IVF — a lab-based fertilization treatment — should be considered “unborn children.” This ruling allows prospective parents to file wrongful death civil suits over embryos.

“Unborn children are ‘children’ ... without exception based on developmental stage, physical location, or any other ancillary characteristics,” Justice Jay Mitchell wrote in the ruling.

IVF is a procedure where eggs are retrieved from a person with a uterus and mixed with sperm in a lab to create a fertilized embryo. IVF is often used by people who are having trouble getting pregnant and same-sex couples who wish to have children.

The ruling has sparked nationwide debate and concern of its implications and has left many to worry about the effect this will have on reproductive rights after the overturning of Roe v. Wade in 2022.
