Clinton man sentenced to probation for 2019 fatal motorcycle accident in Framingham

FRAMINGHAM Nearly five years ago, 21-year-old Evan Maillet was riding his motorcycle in downtown Framingham when he was struck and killed by a Ford SUV.

The driver of that vehicle, Oliveiro Santos, 73, of Clinton, was found guilty Thursday by a Framingham District Court jury of vehicle homicide by negligence.

"There's no winners in this type of situation," said Maillet's mother, Kimberly Maillet. "The families now have closure. Now we can both move on."

Maillet was a 2016 graduate of Keefe Regional Technical School who grew up in Ashland. At the time of his death, he was splitting time between Franklin and Holliston.

The crash occurred about 4 p.m. on June 11, 2019, at the intersection of Beaver and Second streets, authorities said. Maillet was riding his Kawasaki motorcycle when Santos took a left turn in front of him. Maillet crashed into the SUV and died of his injuries, authorities said.

Santos remained at the scene but after an investigation by Framingham police and the Middlesex District Attorney's Office, he was charged.

Victim's mother: 'It's a tragedy for both families'

Maillet said she was upset because many people assumed the crash was her son's fault due to his age and the fact he was riding a motorcycle, when in fact it was due to the negligent driving of Santos.

"It was an accident," said Maillet. "It's a tragedy for both families. The guy (Santos) took a left turn, and he didn't look. He was negligent. I haven't spoken to Mr. Santos. He's a deacon for a church and he's not a bad guy, but we wanted accountability for Evan."

After the guilty verdict, Judge Michael Fabbri sentenced Santos to three years of probation and ordered him not to drive for 10 years.

"After it was over, everyone was crying," said Maillet. "It was a very emotional courtroom. Both families were crying. The lawyers were crying. I ran into his (Santos') daughter as we were leaving the courtroom. I hugged her. We hugged it out and I told her to tell her father I was sorry."

Santos' lawyer, Michael Foglia, could not be immediately reached for comment on Thursday.
