Burglar raped 11-year-old girl while her younger brother slept in the lower bunk: prosecutors

A burglar who raped an 11-year-old girl in her Brooklyn bedroom committed the assault while his victim’s younger brother slept in the lower bunk of their bed, prosecutors said Sunday.

Julio Ayala, 18, a suspected MS-13 member, moved an air conditioner to get into the little girl’s room on Flatbush Ave. and Winthrop St. at about 11:30 p.m. Wednesday, then started moving things around on her dresser, prosecutors said.

As the girl watched in terror, he put his red Chicago Bulls hat on her dresser, flicked the light switch on and off, and climbed into the top bunk, prosecutors said. He then licked her stomach and raped her, according to a criminal complaint.

She screamed, and her parents — who were home at the time — came running into her room, assistant district attorney Victoria Nunez said at Ayala’s arraignment in Brooklyn criminal court Sunday.

Video footage showed him trying to disguise himself

Ayala fled out the window, Nunez said. Security footage showed him running into a building on E. 21st St., then escaping out a window when police came in looking for him, she said.

Surveillance video recovered later showed him trying to disguise himself by putting on a sweatshirt as he walked from Parkside and Flatbush Aves. to Ocean and Church Aves., officials said.

Police caught Ayala Saturday afternoon, after chasing him to a construction site on Flatbush Ave. near Caton Ave. He was carrying a forged permanent residence card and forged Social Security card, the complaint alleges.

Called his arrest a case of mistaken identity

He admitted to being at the scene, and told cops “I have never done anything like this before,” Nunez said.

Ayala’s Legal Aid lawyer, Anna Boksenbaum, called his arrest a case of mistaken identity, and said the girl didn’t pick him out of a lineup.

Though he admitted he was at the scene of the crime, “I question his ability to fully comprehend what was happening. There might have been confusion about what was happening,” she said.

Ayala, who needed a Spanish-language interpreter in court, lives with his aunt, uncle and two cousins in Brooklyn, and works full-time at his uncle’s air conditioning business, Boksenbaum said. She requested Ayala get a psychological evaluation.

Judge Michael Yavinsky ordered Ayala held on $500,000 bail. He’s due back in court Friday.
