Man enraged by noisy kids shot two neighbors with AK-47

An Oregon man enraged by the noise from two children grabbed an AK-47 and shot two of his neighbors before barricading himself inside his home for five hours.

Franklin L. Tomes, 59, shot Jose Gaeta and Tristan Smith, both 20, outside their apartment complex in Newport on Tuesday night, Oregon Live reported. Both men are expected to survive.

Tomes, who hid in his home and finally surrendered after five hours, is now facing charges of attempted murder.

Gaeta was celebrating his birthday on Tuesday night when Tomes, who lives in the apartment below his, complained about the noise from his two young sons, Gaeta’s parents told KPTV.

Tomes got into an argument, grabbed his assault rifle and aimed it at Gaeta and Smith, according to a police affidavit.

The suspect then put the firearm away, only to retrieve it and fire off 12 rounds as Gaeta and Smith tried to run away, the affidavit said.

Gaeta was shot in the foot and once in each leg, according to a GoFundMe page, while Smith was struck in the shoulder, according to the affidavit.

Seven rounds went into Smith’s apartment, while his mother and her boyfriend were inside the home, according to the affidavit. They were not injured.

Gaeta and Smith were taken to the hospital and Tomes returned to his apartment as crisis negotiators along with a SWAT team descended on the scene.

Tomes finally surrendered after five hours. He faces additional charges of first-degree assault, unlawful use of a weapon and reckless endangerment.
