District attorney defends failure to prosecute Harvey Weinstein for groping a model in 2015

The Manhattan district attorney is defending his decision not to previously prosecute Harvey Weinstein — as list of women accusing the movie mogul of sexual harassment continues to grow.

Cyrus Vance, Jr. failed to prosecute Weinstein after he apparently admitted groping a model in a police surveillance audio tape in 2015.

On Wednesday, Vance was mobbed by reporters who asked whether Weinstein’s wealth and fame influenced his decision not to press charges.

"If we had a case that we felt we could prosecute and my experts felt we could prosecute against Harvey Weinstein, we would have," he told reporters.

There appears to be a disturbing pattern in the claims against Weinstein.

First, his alleged victims say, comes the invitation to a fancy hotel suite under the guise of a business meeting. Instead, they find themselves alone with the movie mogul, who excuses himself to use the bathroom.

Then comes complete shock when he emerges moments later wearing only a bathrobe and sometimes nothing at all.

Actress Katherine Kendall joins the growing list of women who are speaking out against the tycoon. She appeared in the 1996 movie, Swingers, which was distributed by Miramax when Weinstein was the head of the company,

"He went to the bathroom and came back completely naked and that is when my adrenaline went through the roof," she told Inside Edition. "I thought, 'I don't know what is going to happen next.'"

Singer Naomi Judd said she is proud of her daughter Ashley for coming forward to speak against Weinstein.

"Ashley was the first," she told reporters. "She is fearless."

Supermodel Cara Delevingne, 25, claims Weinstein asked her to join in threesome in his hotel room.

“As soon as we were alone he began to brag about all the actresses he had slept with and how he made their careers,” she posted in a lengthy Instagram post Wednesday.

When I first started to work as an actress, i was working on a film and I received a call from‎ Harvey Weinstein asking if I had slept with any of the women I was seen out with in the media. It was a very odd and uncomfortable call....i answered none of his questions and hurried off the phone but before I hung up, he said to me that If I was gay or decided to be with a woman especially in public that I'd never get the role of a straight woman or make it as an actress in Hollywood. A year or two later, I went to a meeting with him in the lobby of a hotel with a director about an upcoming film. The director left the meeting and Harvey asked me to stay and chat with him. As soon as we were alone he began to brag about all the actresses he had slept with and how he had made their careers and spoke about other inappropriate things of a sexual nature. He then invited me to his room. I quickly declined and asked his assistant if my car was outside. She said it wasn't and wouldn't be for a bit and I should go to his room. At that moment I felt very powerless and scared but didn't want to act that way hoping that I was wrong about the situation. When I arrived I was relieved to find another woman in his room and thought immediately I was safe. He asked us to kiss and she began some sort of advances upon his direction. I swiftly got up and asked him if he knew that I could sing. And I began to sing....i thought it would make the situation better....more professional....like an audition....i was so nervous. After singing I said again that I had to leave. He walked me to the door and stood in front of it and tried to kiss me on the lips. I stopped him and managed to get out of the room. I still got the part for the film and always thought that he gave it to me because of what happened. Since then I felt awful that I did the movie. I felt like I didn't deserve the part. I was so hesitant about speaking out....I didn't want to hurt his family. I felt guilty as if I did something wrong. I was also terrified that this sort of thing had happened to so many women I know but no one had said anything because of fear.

In 2014, Weinstein told Howard Stern on his SiriusXM show that he was not tempted by all of the women around him. Stern had asked him if he experienced “the mogul aspect” of taking advantage of the people around him.

“Howard, as you know only too well, it doesn’t work that way,” Weinstein said.

Weinstein's behavior has reportedly been an open secret in Hollywood.

Seth MacFarlane even joked about it with Emma Stone at the unveiling of the Best Supporting Actress Oscar nominee in 2013.

“Congratulations, you five ladies no longer have to pretend to be attracted to Harvey Weinstein,” he said as many in the room laughed.

But Lindsay Lohan is publicly coming to Weinstein’s defense.

She posted a black and white Instagram video Tuesday night saying: “Harvey has never done anything to me and we did several movies together. I think it needs to stop.”
