Why wasn't William H. Macy charged in college bribery scandal like his wife, Felicity Huffman?

Felicity Huffman, Lori Loughlin and her husband, Mossimo Giannulli were among the 50 people charged in this week's massive college admissions scheme, in which those indicted allegedly paid William Singer to help get their children into elite universities.

Huffman, Loughlin and Giannulli were all arrested this week on charges of conspiracy to commit mail fraud and honest services mail fraud and subsequently released as they await the next phase of the case, but the scandal has left many wondering why Huffman's actor husband, William H. Macy, hasn't been charged.

According to the charges, Huffman allegedly paid Singer $15,000 to ensure that her older daughter, Sofia, 18, got a boosted score on the SATs. Authorities say that "cooperating witness" Singer had a meeting with both Huffman and Macy at their Los Angeles home detailing how he would pay a proctor to secretly correct Sofia's incorrect answers after she turned in her test, for which Singer instructed Huffman to get her to receive extra time for.

During the correspondence with Singer, it was Huffman who allegedly made the payments and actively participated in the scheme.

"Ultimately, Huffman's daughter received a score of 1420 on the SAT, an improvement of approximately 400 points over her PSAT, taken without [Singer's hired proctor] one year earlier," authorities wrote in an affidavit.

Though the couple allegedly had a phone conversation with Singer to partake in the same cheating scenario for their younger daughter, Georgia, 16, they ultimately decided not to do so until they saw how she performed on the test without any illegal correcting.

Because they didn't decide to go through with the same plan for Georgia, in which Macy seemingly would've been more involved, the prevailing sense is that there was a lack of criminal evidence against Macy to charge him with anything.

It's unclear whether or not Sofia's boosted SAT score got her into any of the elite schools listed in the authorities' documents, which included USC, Yale, Georgetown and more. Sofia is currently a high school senior.

After being arrested at her home at the crack of dawn on Tuesday morning by multiple FBI agents who allegedly had their guns drawn, Huffman was released after paying her $250,000 bail. Her next hearing is set for March 29 in Boston.

Loughlin, who was shooting a project in Vancouver, Canada, on Tuesday, flew back to Los Angeles and surrendered to the FBI on Wednesday. She was later released after paying her $1 million bond. She and her husband are charged with allegedly paying Singer $500,000 to get each of their daughters into the University of Southern California by pretending that they were athletic recruits for crew. Neither of their daughters, Isabella Rose and Olivia Jade, participated in the sport.

William H. Macy turned 69 on Wednesday, one day after the charges were announced.
