Jared Fogle asks for 5-year prison term on child pornography charges, is 'profoundly sorry'

Federal Prosecutors Request Maximum Sentence of 12.5 Years For Jared Fogle

Jared Fogle's attorneys are asking for the minimum prison term they said they would seek in August, when the ex-Subway pitchman plead guilty to child pornography and sex charges.

In new court documents obtained by ET, Fogle's attorneys ask for a five-year prison term, and say that the 38-year-old father of two is "profoundly sorry" for his actions, and has been "working to take responsibility for his conduct."

"As he will tell the Court himself next week, Mr. Fogle is profoundly sorry for what he has done," the documents read. "He is painfully aware of the fact that he has impacted the lives of minor victims, hurt those closest to him, and, for all practical purposes, destroyed the life he worked to build over the last eighteen years."

"Since law enforcement searched his house in July, Mr. Fogle has worked to take responsibility for his conduct, to assist the minor victims in this case, to make amends with his family, and to address his medical issues," the documents continue.

Meanwhile, prosecutors submitted their own sentencing memorandum, requesting a 12 and a half year term -- the most they had agreed to seek under the plea deal. They also recommend "a lifetime period of supervised release."

Fogle is scheduled to be sentenced by Judge Tanya Walton Pratt on Nov. 19 in Indianapolis, Indiana, and she has the discretion to sentence him to more or less than what the prosecution requests.

Fogle pleaded guilty to one count of travel to engage in illicit sexual conduct with a minor, and one count of distribution and receipt of child pornography in August. In addition to serving at least five years in prison, he will also pay $1.4 million in restitution to 14 minor victims, and will now be required to register as a sex offender and undergo treatment for sexual disorders.

ET spoke to Dr. Phil in late October about Fogle, whom the daytime talk show host called "a very sick individual."

"I think he's incredibly narcissist, this is something that is perverted at his core -- this is a core value thing for him," Dr. Phil said. "When you listen to him, he's proud. This isn't something that was kind of eating away at him and he reluctantly gives in to impulses. He's proud of this. This is sport to him, this is something he really wants to do."
