Guidelines and Release Agreement

Before providing your submission -- be it a story, comment, video or a photo or other material -- for use on this site and/or in connection with appearing on the AOL platform you must read and agree to the terms outlined in these Guidelines and Release Agreement.

BY AGREEING TO THE TERMS OF THESE GUIDELINES AND RELEASE, SUBMITTING CONTENT AND/OR APPEARING ON ANY AOL PLATFORM, YOU EXPRESSLY AGREE AND CONSENT TO BE BOUND BY ALL TERMS OF THIS AGREEMENT AND AOL'S TERMS OF SERVICE, COMMUNITY GUIDELINES, AND PRIVACY POLICY. YOU ACKNOWLEDGE THAT YOU ARE ACCEPTING THE TERMS OF AGREEMENT ELECTRONICALLY, WHICH HAS THE SAME FORCE AND EFFECT AS AN AGREEMENT SIGNED IN WRITING.

Guidelines

Your submission/appearance must be original work.

You must have consent from each and every person (whether or not a celebrity or public figure, and including permission from parents of minors), and for all images, trademarks or other visuals depicted in your submission/appearance.

Your submission/appearance may not contain any music, including music played on a radio or television in the background, added in as an audio track, or used in any other manner.

Your submission/appearance shall be suitable for users under 18 years of age.

Your submission/appearance shall not contain content that portrays graphic violence, language or other acts resulting in serious injury or death, including those of a sexual nature, sexually explicit images of a pornographic or obscene nature, and/or material harmful to minors.

Your submission/appearance shall not contain personal information not your own and/or posted without permission.

Your submission/appearance shall not be intended to victimize, harass, degrade or intimidate an individual or group of individuals on the basis of age, disability, ethnicity, gender, race, religion or sexual orientation.

Your submission/appearance shall not include illegal or incite illegal activity or that violates local, state or federal law.

Your submission/appearance shall not advertise and/or promote the sale of the following products or services: lotteries, ammunition, firearms, fireworks and other explosive materials, tobacco, alcohol, adult products and services, such as phone sex and escort services, illegal products and services, and other products and services AOL deems inappropriate.

Your submission/appearance shall not contain any false or misleading statements or any material that is considered to be libelous, slanderous, defamatory or that constitutes an unlawful invasion of privacy.

Release

Submissions. By submitting your story, comment, video or photo or other material (the "Content") or by incorporating any such Content in any appearance by you on the AOL platform, you hereby grant AOL Inc., its affiliates, subsidiaries, assigns, licensees and legal representatives ("AOL") the irrevocable, perpetual, worldwide, gratis and royalty-free right to use, reproduce, edit, market, store, archive, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote any or all of the Content (as such may be edited and modified by AOL in its discretion), in any medium now known or hereafter devised, online or offline and by any means of delivery, for editorial, commercial, promotional and all other purposes. You understand that AOL has no obligation to use your submission or to permit you to appear on any AOL platform, including without limitation.

Appearance. For good and valuable promotional consideration, the receipt and sufficiency of which is hereby acknowledged, you hereby grant to AOL, the world wide gratis right to webcast and simultaneously live stream (or stream subject to a short time delay) and tape, photograph, film and otherwise make visual, sound, and audiovisual recordings of you, your rehearsal and your performance and interview, if any (collectively, the "Recording") and you grant AOL the irrevocable, perpetual, worldwide gratis and royalty-free right to use, reproduce, edit, market, store, archive, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Recording in any media or field of use and via any means of distribution or delivery, and in any manner that AOL may determine, and to use your name (including any name by which you are professionally known), likeness and biographical material in connection with the Recording.

Disclaimer. Due to the nature of AOL platform, there is a possibility that similar submissions may be submitted by multiple individuals. Any similarity between submissions shall in no way entitle you to any consideration or compensation from AOL or any third party, including in the event an individual with a submission similar or identical to yours appears on the AOL platform. By providing your submission and/or appearing, you specifically acknowledge this possibility.
General. You hereby represent and warrant that: (1) You are over 18 years of age, have read this release, and are familiar with and understand its contents; (2) the Content is your original work; (3) You have the authority and are free to grant all of the rights granted in this release and that additional clearances or permissions are not necessary for AOL to exercise any of the rights granted in this release including without limitation, all necessary copyright and other related rights to the Content, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity; (4) your Content or appearance does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation and (5) you have obtained written permission from any people seen in the Content allowing you to submit the Content to AOL for this purpose (6) no monies are due me, or any third party in connection with AOL's use of the Recording, my participation in any AOL programming, and AOL's exploitation of its rights as set forth herein, including without limitation, to any record label, publisher, guild, union or collection society; and (7) You will defend, indemnify and hold AOL and each of AOL's parent, affiliated, subsidiary, AOL sponsors and/or related entities and parties harmless from and against any breach or alleged breach of any of agreements, representations and warranties made by you hereunder or any use of the Content or your appearance. In addition, you agree to bear all risk and hold harmless AOL in the event of any personal injury or loss of any kind that you may suffer as a result of your voluntary participation in and performance of any potentially hazardous stunts, acts, activities, or other physically demanding behaviors during your performance and/or appearance on AOL. You waive any right to privacy. You waive any right to inspect or approve uses of the Content or to be compensated for any such uses.
