A quadriplegic man who was allegedly left stranded on the "It's A Small World" ride after it stalled is suing Disneyland in federal court.

Jose Martinez says he was left alone for 40 minutes after staff evacuated other passengers off the ride, reports Associated Press.

According to the lawsuit filed Monday in U.S. District Court, Martinez alleges Disneyland is in violation of the Americans With Disabilities Act because proper procedures are not in place for evacuating disabled passengers from the ride.

Martinez alleges Disney employees failed to summon paramedics when his blood pressure spiked while he was abandoned on the ride. He is suing for negligence, emotional distress and liability.

In a statement, Disneyland Resorts says it is accessible to all guests and has procedures in place for evacuating disabled customers.
