APD files more charges against a man who allegedly pointed a gun at an officer

May 21—A man accused of pointing a handgun at an Albuquerque police officer during a foot chase last week is facing two more charges.

Joey White, 38, is charged with receiving stolen property (a firearm) and being a felon in possession of a firearm. This is in addition to his other charges of aggravated assault upon a peace officer with a deadly weapon and distribution and possession with intent to distribute controlled substances.

Albuquerque Police Department spokesman Gilbert Gallegos said White initially told detectives he pointed a BB gun at the officer who was chasing him on Friday during an encounter in the area of 130 Mesilla NW.

According to a criminal complaint filed in Metropolitan Court, the officer's lapel video showed him saying, "You're under arrest," before White ran away. The video showed the officer pick up the bag of fentanyl and chase White in his vehicle.

The officer said White pointed a gun at him during the foot chase, "causing him to be in fear for his life and believing he was going to be shot," according to the complaint. White told police that when he was running from the officer, he pointed a black BB gun at him and then "threw the handgun away as he continued to flee."

Gallegos said a resident called police after a woman claiming to be White's wife asked if she could search in their backyard for her husband's property. The resident did not allow her to search because they knew officers were searching the yard earlier.

Gallegos said officers returned to the yard on Saturday and found a stolen, loaded 9mm handgun under an old washing machine in the backyard.
