63-year-old faces murder charge in 2021 Otisville federal prison death

OTISVILLE - Federal officials on Wednesday accused a person who was being held at the Federal Correctional Institution at Otisville of murdering another person held there in 2021.

According to a news release from the office of the U.S. Attorney for the Southern District of New York, Daniel V. Smith, 63, was charged with one count of first-degree murder, a felony.

Smith allegedly murdered Patrick Deck, who was also being held at Otisville, on or about Oct. 26, 2021. Smith appeared Wednesday before Magistrate Judge Andrew E. Krause in U.S. District Court in White Plains.

Smith faces a maximum sentence of death if he is convicted of the murder charge.

No other details about the murder were included in the news release or an accompanying copy of the indictment of Smith. The U.S. Attorney's Office also did not say why Smith is serving time in Otisville.
