(PINKSHEETS: ATPAQ) "ATP" in the United States District Court for the Northern District of Ohio for possible federal securities laws violations, Section 10(b) and Section 20(a) of the Securities Exchange Act, and Rule 10b-5 promulgated thereunder. It is alleged that the Registration Statement and Prospectus filed by ATP on October 12, 2010 contained several false and misleading statements and/or misrepresentations with respect to ATP's business and prospects, financial position and results of operations. ATP is believed to have continued with its series of misstatements and omissions of relevant facts to the investing public until its bankruptcy filing on August 17, 2012. This series of misrepresentations and omissions caused ATP share prices to be artificially inflated during the Class Period, which has been defined as December 16, 2010 through August 17, 2012.
