ITC Reviewing Apple's Patent Victory Over Motorola
The U.S. International Trade Commission announced in a recent notice that it will review a judge's decision last December that claimed a number of Motorola Mobility's patents invalid, ensuring that Apple avoided patent infringement allegations.
In the original decision, Motorola's technology automatically dimming a device's display when held close to a user's face was declared not different enough from an earlier design of a similar technology. Motorola filed a petition of this decision in early January, with Apple responding in kind with its own petition for review.
According to the ITC's release, the commission will spend time particularly reviewing the claims around the phrase "touch sensitive input device" and its context in the decision and in Motorola's patent claims. A final decision is expected in April.
