Dex One Statement Regarding Ninth Circuit Court Decision

CARY, N.C.--(BUSINESS WIRE)-- The following statement can be attributed to Alfred T. Mockett, CEO of Dex One Corporation.

"Today's court decision is a victory for free speech and the rights of local business owners in the city of Seattle. We have contended from the outset this action by the City Council was a burden on local businesses and a violation of our First Amendment rights.

We have always believed the ordinance was unnecessary and are pleased the Ninth Circuit has reached a decision that allows Dex One to help local businesses and consumers connect without unnecessary regulation."

Dex One has a long-standing commitment to promoting consumer choice, allowing consumers to customize their directory order online or by calling 866-60-MY-DEX.

Background:

Earlier today the Ninth Circuit Court of Appeals struck down the directory distribution ordinance adopted by the Seattle City Council in 2010. The court correctly recognized Yellow Pages directories contain more than just advertising and should be afforded the same protections that newspapers and magazines enjoy today.

This ordinance required publishers to obtain a license to distribute directories, pay a fee for each book distributed, participate in the city's redundant opt-out registry and advertise the City's registry on the front of each directory.

The Ninth Circuit stated: "Users consult phone books for a number of reasons, including finding business, government and...identifying businesses that provide a desired service or good, comparing goods and services available from multiple sellers."
