Court Appoints Independent Chair of Western Wind Annual General Meeting
Denies Western Wind's Petition Against Savitr Related to Alleged Trademark Infringement
Savitr Alerts Shareholders There is Still Time to Vote Their GREEN Proxy
TORONTO--(BUSINESS WIRE)-- Savitr Capital, LLC ("Savitr"), representing significant shareholdings of Western Wind Energy Corp. (TSX Venture Exchange: WND) (OTCQX: WNDEF) ("Western Wind"), today announced that the British Columbia Supreme Court ("the Court") has appointed an independent chair of the September 25, 2012 annual general meeting of Western Wind shareholders (the "Meeting"). Savitr brought a petition seeking this appointment and, while the appointment of an independent chair is not granted in the ordinary course, the Court held that the series of events in this case gives rise to a reasonable apprehension that the chairmanship of the Meeting by Mr. Boyd, who reports to Mr. Ciachurski, will not be conducted fairly.
Concurrently with this appointment, the Court dismissed in its entirety Western Wind's petition based on alleged trademark infringement by Savitr in a communication to Western Wind's shareholders. This follows a similar decision yesterday by the United States District Court for the Northern District of California in which Western Wind's motion for a temporary restraining order based on alleged trademark infringement by Savitr was denied in its entirety.
