Mortgage Modifications Scaring Away Lawyers

Saving your home from foreclosure with a mortgage modification has gotten much harder in California in recent months. The reason is a law passed by the State Legislature in September 2009 prohibiting lawyers from collecting any fees related to mortgage modifications from clients until the related work is finished. The law was written to prevent unscrupulous mortgage modification firms from demanding large upfront fees and then not delivering on their claims. Now many lawyers in California are hesitant to accept mortgage modification cases that may drag on for months or years without any remunerative payoff. As a result, California homeowners are have a tough time finding attorneys to represent their interests in court.
