Foreclosures: Renegade Sheriff Won't Evict

Updated

There's a new sheriff in town -- or at least, a new role for the sheriff in Cook County, Ill. Sheriff Thomas Dart announced Friday that he would not evict residents from their homes in cases filed by a four major banks about to resume foreclosure proceedings, as of Oct. 25.

Illinois is one of the 23 states where a judge is required to sign off on all foreclosure cases. Far from a real estate Robin Hood, Dart said that he was simply following the law: "I can't possibly be expected to evict people from their homes when the banks themselves can't say for sure everything was done properly."

Sheriff Dart made a similar declaration two years ago when he refused to carry out evictions for banks that gave foreclosed owners no advance notice.
