Pediatrician Continues Working After Child Pornography Conviction

ST. LOUIS, MO (KTVI) - A St. Charles County pediatrician is a convicted sex offender. Federal court records reveal he admitted distributing child porn to Chicago. Yet he remains a doctor to children.

I asked Dr. Richard Leahy outside of his pediatric office, "How do you explain being able to examine kids with your conviction?" He shut his car door and drove away.

We found Dr. Leahy working as a pediatrician at 1600 Heritage Landing in St. Charles, MO.

Mariela Nair told us, "I kind of put up a big fight. I was like no he`s not."

Nair had been taking her little ones to him for years. Then someone pointed out his mug shot on a sex offender registry.

She said, "I was shocked to find out someone with so much power could be on the registered sex offender (list). That was mind blowing."

Victoria Stadler`s been going to Dr. Leahy since she was 15. She thinks people deserve a second chance, but she added, "When you`re looking at child pornography and then you go back to being a pediatrician, that does not seem right to me."

Dr. Leahy did not stop to answer our questions, except to say he`s licensed. We found his conviction in Federal Court. 20 years ago he admitted "distributing" to Chicago a "visual depiction of a minor engaging in sexually explicit conduct."

The Missouri Board of Healing Arts stripped his license. Then after he served prison time, the Board gave him a special probationary license, noting that he was "restricted from treating female patients under 18."

The State Board lifted the restriction two years later.

Victoria and Mariela look back at the years they've seen Dr. Leahy and wonder if he could've said something. Mariela added, "He has his tablet (iPad) and if he goes to do anything, there`s a picture button on the tablet. Who`s not to say, like I could be standing as close as you and I and he`s looking at his tablet, who`s not to say that he doesn`t take a picture of my kid while I`m standing there."

Victoria said she confronted someone in his office. She said, "I asked the receptionist about the whole ordeal and she goes...`hmm`" Victoria laughed and added, "That`s it. She did not answer me at all."

So she asked Dr. Leahy himself and recorded his response with her iPhone.

You can hear Dr. Leahy answer, "Yeah that was 25 years ago when the internet was new. I accidentally got onto something that I shouldn't have been on and I don`t know what to tell you except that it happened." Victoria followed up asking, "How did it happen?" Dr. Leahy responded, "Not paying much attention."

We found nearly 100 doctors who were also issued probationary licenses like Leahy was, just in the past five years.

The list reveals a variety of past allegations. It shows Dr. Lisa Armbruster, from Lincoln County, who reportedly treated patients while under the influence of alcohol. It also lists Dr.Fazle Yasin, a psychiatrist from Creve Coeur. Regulators say Dr. Yasin "touched a patient" and "asked if he was having an erection in order to determine the patient's sexual identity."

You may have no way of finding out, unless you know where to look. Victoria and Mariela say they found out about Dr. Leahy through Facebook, after someone happened to see the doctor's face on a sex offender registry.

You said it`s not easy to find doctors who`ve faced probation. What can patients do?

Dr. Leahy does not appear on either list because the regulatory enforcement actions were in the 90's. You can read the "Order" and "Findings of Fact" here
