Jessica Alba's Honest Co. Comes Forward in Sunscreen Scandal

Jessica Alba's Honest Company is being sued for not being so honest after all.

A consumer named Jonathan D. Rubin filed a class action lawsuit Thursday against The Honest Company Inc. at the District Court of Northern California in San Francisco claiming products described as "natural" actually contain synthetic preservatives, according to legal documents obtained by TheWrap.

Included in the list of those being "deceptively and misleadingly labeled and marketed" for containing unnatural ingredients are Honest Hand Soap, Honest Dish Soap, Honest Diapers and Honest Multi-Surface Cleaner. Meanwhile, Honest Sunscreen "is ineffective," states the lawsuit.

"Honest also labels and markets the Products as 'natural' its website, on third party marketplace websites, and in print and television advertisements," it continues.

Alba came under fire last month when customers complained that an SPF 30 sunscreen the actress' billion-dollar company sells isn't very effective, and their skin is getting sun burned as a result. A statement from Honest maintained that the product was "safe and effective" and said, "The number of complaints received on our own website about our Sunscreen Lotion constitute less than one half of one percent of all units actually sold at honest.com."

In the new lawsuit, Rubin claims the sunscreen, which he bought at Gelson's Markets in Los Angeles, was "ineffective in preventing unhealthy exposure to harmful UV rays."

Since Sept. 2012, Honest, which is based in Santa Monica, California, has marketed itself as a "natural products" company, and has based its advertising campaign around that.

Unnatural materials that lawsuit claims are in Honest products include Methylisothiazolinone, a synthetic preservative, Cocamidopropyl Betaine, a synthetic surfactant, Phenoxyethanol, a synthetic preservative, and Sodium Polycrylate, a petrochemical-based additive.

Rubin is asking for all profits generated from the products stated to be refunded to people who have purchased them and damages determined by the court of at least $5 million.

Rubin is legally represented by attorneys Nicholas A. Carlin and Conor H. Kennedy of Phillips, Erlewine, Given and Carlin, LLP of San Francisco.
