Redskins appeal trademark decision on team name


ASHBURN, Va. (AP) -- The Washington Redskins on Thursday formally appealed a ruling that stripped the team of trademark protection, the latest legal maneuver in the franchise's attempt to defend its name against those who consider it a racial slur.

The team announced that it had filed its complaint in the U.S. District Court for the Eastern District of Virginia and that it "points out the many errors" in the decision by the U.S. Patent and Trademark Office.

The office's Trademark Trial and Appeal Board voted 2-1 on June 18 to cancel six uses of "Redskins" trademarked from 1967 to 1990, saying the name is "disparaging of Native Americans."

"We believe that the Trademark Trial and Appeal Board ignored both federal case law and the weight of the evidence, and we look forward to having a federal court review this obviously flawed decision," Redskins lawyer Bob Raskopf said in the team's statement.

The team had previously said it would appeal the ruling and had two months to do so. The trademark protection remains in place while the matter makes its way through the courts, a process that could take years. A similar ruling by the trademark board in 1999 was overturned on a technicality in 2003.

The Redskins say they will ask the court to consider "serious constitutional issues," including whether the ruling penalizes the Redskins' right of free speech and whether the team has been unfairly deprived of "valuable and long-held intellectual property rights."

The Redskins have been under sustained pressure to defend the name over the last 18 months, with major political, church and sports figures joining Native Americans in saying it should be changed.

Team owner Dan Snyder has vowed never to change the name, calling it a "badge of honor."

For years no one considered "Redskins" to be a racial slurr. If it is a slur to someone, that is because they use it as a racial slurr not because the team uses it that way. Its an honor that the team bestowed as they respected this image. NO ONE uses a punk image to define their team. Its time for the wackos who try to run everyone elses life to go home put their feet up and smoke another joint. How can you respect someone who tries to change the name of a team that has existed for years without anyone else even thinking this was a racial slur. This intellectual stupidness needs to stay with the selfish people who have nothing better to do with their time than try to change everyone else.

I am Native (Oglala Lakota) and I am getting a great load of laughs over a bunch of white people suddenly speaking for me and my peopel. A bunch of bleeding heart (probably rich) folks are trying to protect my feelings by forcing the Redskins to change their name. Seriously? Are these same peopl in favor of giving raparations to the black folks for slavery? I doubt it because that would cost them something.
Let me state my point clearly; we REAL Americans do not need your help in the form of protests over supposedly offensive team names. In plain English, that is worthless bullshit. Whites had no problem running Natives off of our land, slaughtering women and children and changing the blandscape of this continent. Do you really think standing up to change the name of an NFL team means anything? Wake the hell up!!!

There is no slur or disrespct in the name Red Skins. There never was and it was never to be meant as a slur. Get out of the political legal mode. There isn't any thing a person can say today without some one taking exception. Act like people rather than a bunch of liberal holyer than you attitud. If the American Indians want it changed let them do it not a bunch on liberal left wingers stiring the racial pot again.
