Typo leads to early release of convict



New Orleans inmate Isiah Spencer, 30, served just 3 months of his 33-month sentence before being released in error Friday.

According to WHNT, 'Court records show the minute clerk for Section K of Orleans Parish Criminal Court entered Spencer's sentence as three months at Orleans Parish Prison, instead of the 33 months indicated in his guilty plea.'

WWLTV has the background on Spencer's arrest:

'Spencer was arrested on an aggravated battery charge in August 2013, but was later indicted for second-degree battery and false imprisonment. The arrest warrant says the victim told Spencer she didn't want to have sex with him the night of the beating, so he punched her on her left side, kicked her in the same spot while she was down, then stomped on her back.

The warrant states the victim told police she 'became paralyzed,' couldn't move and was in 'indescribable pain.'

Spencer took her phone and wouldn't let her call for help until the next morning.

According to CNN, Spencer beat his victim so badly that she had to have surgery to have her spleen removed.

The judge whose signature is included on the court document did not return a call seeking comment Thursday.

CorrectionsOne.com notes that 'the Orleans Parish District Attorney's Office said they reached out to the court to correction the error when they found out about it. The victim in the case will receive victim assistant services until Spencer is recaptured.'

First of all..this animal should have received lot more than 33 months, it should have been 29 years. He should be made to pay all of her medicall bills, and pay her for pain and suffering..Our system sucks..

I think someone needs to check if this clerk was a friend or relative of this evil person. And why such a short sentence as this was given for such a brutal crime. Seems like 10 or 15 years would have been a more appropriate prison term. Give all of us a break. New Orleans has enough violent crime without this thug being back on the street.

Government at it's finest and we tax payers can't fire them due to union rules. The country is falling apart felons released, borders unsecured, illegals with more rights than citizens, and voters keep listening to the Pied Piper's promises. Sad state of affairs.

A clerical error should not change a sentence. The court papers take precedence. Hey, try getting away without paying your taxes or a bill due to a clerical error. They correct the error and you pay.

I agree. A sentence is a sentence. Just like everything else it is recorded. The typo should be corrected and he needs to stay in prison.

SO ARE THEY GOING TO GO AFTER THIS IDIOT AND PUT HIM BACK IN JAIL NOW ? THEY SHOULD BE WATCHING OUT WHERE THE VICTIM LIVES TO SEE IF HE GOES AFTER HER....

THERE ARE WAY TO MANY ON DEATH ROW WHO GET A CHANCE TO BE FREE NOW...
