Clippers owner's lawyers seek to make case federal

LOS ANGELES (AP) - Shortly before the start of a trial to determine whether Los Angeles Clippers owner Donald Sterling's estranged wife can sell the team, his lawyers filed a motion Thursday to move the case to federal court, alleging his medical privacy has been violated.

A probate court trial is scheduled to begin Monday to determine whether Sterling is mentally incapacitated and Shelly Sterling can assume control of the family trust that owns the Clippers. She struck a deal in May to sell the team to former Microsoft CEO Steve Ballmer for $2 billion after Donald Sterling's racist remarks to a girlfriend were publicized and the NBA moved to oust him as an owner.

On Thursday, Donald Sterling's attorneys filed a notice of removal to federal court, saying the airing of his medical information in the probate case violates federal privacy laws. In previous filings, they argued that Donald Sterling submitted to examinations of his mental competence under false pretenses, that there was undue influence in the doctors' findings, and that the examination and letters about his capacity were defective and incomplete.

Shelly Sterling's attorney, Pierced O'Donnell, called the move a "cowardly ploy" and said allegations of federal privacy violations are "preposterous" because Sterling expressly authorized public release of his medical records under the terms of his family trust.

"Donald Sterling's 11th-hour attempt to move the probate trial into the federal courts is a desperate act by a desperate man," O'Donnell said in a statement.

Ballmer's attorney, Adam Streisand, also called the move "desperate" and said his side would seek to block it.

"We will be filing emergency relief in federal court to undo this last desperate and frivolous attempt to block our trial from going forward Monday," Streisand said in a statement.

Donald Sterling's attorney Bobby Samini denied the move was mere gamesmanship, saying "we feel strongly that this important issue should be addressed by the federal court at this time."

"While it has become popular to attack Donald Sterling for his regrettable comments, his right to privacy and to the protection of his medical records should not be acceptable collateral damage," Samini said in a statement.

It was not immediately clear when a federal judge might rule on the issue, but the trial in state probate court remained scheduled to start Monday morning.

If Sterling is mentally incompetent to manage his own business affairs then he wasn't mentally competent when he made the statements that were the basis for the NBA taking away his franchise. In America we don't try or convict people who aren't mentally competent. The NBA shouldn't be able to have it both ways. If he wasn't mentally competent you can't penalize him for what he said.

Don you are so right. My heart goes out to Donald, as not only is he old, but this was a private conversation, and a private argument. She is half black, and even with him being old, he still could of got whatever woman he wanted, so he couldn't be too racist since he picked a half black. I don't care what is said during a private conversation, as we have all said things we regret, especially to our spouses.

Blacks play the race card all the time NBA is 90%black player's why they don't draft white player's .white players play High school,college..they are some good players .they can keep that NBA for now i burned all my knicks jersey's and hats .i rooted for the knicks even though their was black players there.that never materd to me i treated everyone egual.this country is getting divided more and more it's time i stand on my own side of the fence

Don Sterling didn't make the money in LA. Real Estate being stupid. He plays the game two quarters ahead of the rival team when it comes to finances. He will cost the NBA bigtime in court in legal fees which will NOT make the franchise owners happy because they will have to foot the legal bill, THEN he will (and ex) sell the team he bought for 9 mill for 2 Bill. Yeah, GO DONALD, you poor old mentally ill fuddy duddy LOL

In real estate he has already lost a case base on racism and paid out I believe 6mil. . They way it stands now, he has little control over his money and property that is what the incompetency was about. was about. This was brought on by Bank of America who holds the trust and his wife soon to be ex. Bank of America lose many cases? A bitter ex-wife will most likely give him a small allowance and care takers. Sterling when buying the team signed an agreement that any action resulting in the NBA losing money, they can force him to sell or take the team and sell it themselves. The NBA has lost money. Clippers paraphilia being sold has dropped 90%. Since the NBA shares revenue on this stuff the other owners have a right to do what they want. In the end its always about money. As to other owners, they will be very happy with brining in the new owner, a founder of Microsoft who makes Donald look poor.

He didn't lose the real estate case; he settled. Over 99% of the cases filed are settled and good businessmen ultimately settle most cases or claims regardless of liability because it makes good business sense. You neglected to mention that Sterling continued to employ Elgin Baylor as GM of his team for 25 years even though Baylor was a failure at putting winning teams together and putting paying customers in the seats. Baylor did sue Sterling for racism and Baylor lost.
