Judge says Pistorius to get psychiatrist test

PRETORIA, South Africa (AP) - The judge overseeing the murder trial of Oscar Pistorius on Wednesday ordered the double-amputee athlete to undergo psychiatric tests, meaning that the trial proceedings will be delayed.

The decision by Judge Thokozile Masipa followed a request for a psychiatric evaluation by the chief prosecutor, Gerrie Nel. The prosecutor had said he had no option but to ask for it after an expert witness for the defense testified that Pistorius had an anxiety disorder that may have influenced his judgment when he fatally shot his girlfriend, Reeva Steenkamp.

Masipa said the court was "ill-equipped" to assess the diagnosis by Dr. Merryll Vorster, and should therefore send Pistorius for a period of evaluation. She said it was important to assess the Olympic runner's state of mind because of questions raised by the prosecution that Pistorius might argue he was not criminally responsible because of his anxiety disorder.

"The accused may not have raised the issue that he was not criminally responsible at the time of the incident in so many words, but evidence led on his behalf clearly raised the issue and cannot be ignored," the judge said.

Masipa noted that having Pistorius evaluated as an outpatient would be preferable as the referral for psychiatric analysis was not meant to punish him, and acknowledged that trial proceedings would be delayed for an unspecified amount of time.

"This is not about anyone's convenience, but rather about whether justice has been served," said Masipa, adding that she would provide details about her decision in court on Tuesday.

Nel, the prosecutor, had previously referred to a period of 30 days for a psychiatric evaluation. Any panel of experts that assesses Pistorius would likely take additional time to compile a report and submit it to the court. The trial started March 3.

Pistorius says he killed Steenkamp on Feb. 14, 2013 by mistake, thinking there was an intruder in his home. The prosecution says the Olympic runner killed her after an argument.

Yes, he is mentally ill. It's called narcissistic personality disorder. But it doesn't mean he didn't know exactly what he was doing when he shot her.

I must say that I am not one who believes in proclaiming someone guilty prior to all evidence being heard. However, I do find it strange that the lady asleep in his bed would be fully clothed. It is most likely that she got up to leave the house, entered the rest room in preparation to leave when he shot her. The evidence that I have heard or read points this direction. I just do not believe that one would shoot a would be burglar while he was locked in a small space and cannot harm you or escape without unlocking and opening that door which you are guarding with a loaded weapon.

I find it amazing how EVERYONE that A) wasnt THERE..... B) wasnt involved... and C) ISNT in the courtroom to hear the ENTIRE testimony instead of the few snippets that "would make good news stories".. have the nerve to condemn a man just by what the newscast DECIDES is relevant. and to the moron who said Oscar is not used to not getting his way because he "has been spoiled his entire life because of his disability" i have only this to say.. YOURE A FRICKIN IDIOT! Why dont you sever your own legs and see what he has had to go thru his entire life? To be ignorant enough to make the statement you did just proves that people like YOU need to be sterilized so that you dont reproduce! I've said it before and I will say it again... INNOCENT UNTIL PROVEN GUILTY. Oscar never said he DIDNT fire the shots that killed her, he is saying it WASNT premeditated... and as you can see, PROVING premeditation is a helluva lot harder than it seems.

He's changed his voice. When the trial first started, on and off, his voice goes high. Everyone that heard the screaming during the shooting was sure it was a woman but suddenly Oscar has his lawyer tell the court that it wasn't Reeva, it was him screaming. So I went and listened to dozens of interviews with him from better times. His voice is lower in those interviews. Markedly and noticably lower. When I watched interviews after he'd won a race and he was all excited - his voice did not go sky high like it did at the trial. This speaks volumes because THAT is manipulative and calculated. But this is my opinion. I encourage people to go listen to Oscar on Jay Leno, etc. from years ago then compare it to him on the stand in that semi-whisper that makes him sound like a little girl. I just don't buy his story. He wanted that person dead. Why would you start shooting into the door when you have the person caught like a rat in a cage? Doesn't make sense unless he knew who was there.

I'm curious as to why he stayed in a country that has that much crime, if he had to have weapons to protect his house to which all this anxiety was created. They both have/had plenty of money to change all that.

There is crime in every country Joy. You can't "move" away from it, sadly.

...and the innocent gets convicted, and the guilty walks free, and the lawyers get richer, and the healthy gets institutionalized, and the afflicted gets incarcerated, all on falsehood, and it's business as usual, and on and on the story goes......

I don't like the judicial system. He killed, or murdered (depending on if you thinks he's guilty) this woman. He shot her, if it was a mistake, he still did it. I don't care that he's got an anxiety disorder, or the devil made him do it, or whatever the defense team dreams up to take away his responsibility for her death. He ended her life. You'd think he'd man up and take his punishment. He said he loved her, so Oscar, quit wasting the taxpayers money and just own up to what happened. The judicial system is no more. It's all about getting away with your crime, because of whatever reason and if you have a lot of money?? Well, you can do anything.

He says she was in bed beside him yet she was fully dressed. I don't know about anyone else but when I retire for the night, I certainly don't do it in street clothes. And, the story he tells is just so much horse manure. It is like he is saying "this is my story and I'm sticking to it." They were fighting, she was leaving and he wasn't going to allow her to do it. This is a guy who has been spoiled and catered to his whole life because of his disability. He isn't used to not getting his way and he obviously has a nasty temper. The unfortunate thing is he will more than likely get out of this and she is still dead. So you're right, we weren't there but it is pretty obvious what happened.

Don't need a Psychiatrist to understand this fellow is a psycho killer... Even so, it doesn't make him innocent of premediated murder. He won't have a gun in prison but he will be armed, legged with blades, mostly for running, like the coward he is, no doubt..
