Judge to Ohio: Recognize out-of-state gay marriage

Federal Judge Says Ohio Will Recognize Gay Couples

By AMANDA LEE MYERS

CINCINNATI (AP) - A federal judge has ordered Ohio authorities to recognize the marriages of gay couples performed in other states.

Judge Timothy Black's ruling on Monday criticized the state's "ongoing arbitrary discrimination on the basis of sexual orientation."

He says the state's marriage recognition bans are unconstitutional and unenforceable.

Black's order doesn't force Ohio to allow gay marriages to be performed in the state.

The state plans to appeal Black's ruling, arguing that Ohio has a sovereign right to ban gay marriage, which voters did overwhelmingly in 2004.

Black delayed deciding whether to stay his ruling pending appeal until attorneys on both sides present their arguments on the issue by the end of Tuesday.

The final sentence of the article has confused me, "Black delayed deciding whether to stay his ruling pending appeal until attorneys on both sides present their arguments on the issue by the end of Tuesday." Does that mean marriage will happen since he delayed deciding to stay his ruling? Or is it still in limbo because he has not decided to stay it or not??

Another great article from AOL/HP. Notice the lengths went to discuss the subject, the point and counterpoint? The relationship to consitutional law, and the way the article looks deeply in to implictions? Nah--just do what they always do...pick a subject from the 10 or so they beat to death ( racism,LGBT rights, businesses like Wal-Mart, Koch brothers etc.) and throw a few lines out there. Its just chumming for argumentative and polarized posters.
No wonder an article on Pulitzer Prize winners announced today doesn't include the putid level of journalism we see here....

I'm wondering why we even bother with elections and legislatures anymore, given that the judiciary seems to be doing everything. Most of whom are appointed and not elected.

In this case, they are following the literal wording of Article IV of the US Constitution. It is not like some decisions based on "inspiration whereever it might be found".

Love is love, I could give a crap with whom loves whom. Isn't love a WHOLE beter than hate. This is a year that athletes, both men and woman have come out. Hey Tc....time for you to open your blinds and understand this NEW world. I would bet that there is at least 1 person you know that has come out.
People, there should be NO reason to "come out". Be yourselves, and you will be loved. As I said, I love the ladies, but have so many friends that love both! Hey Truc-get over yourself!!

What has happened to this proud country? It isn't based on freedom? Tuc, you're thoughts will NEVER be how America has grown. OUR America has so much to offer for All. You think gay people have no rights here? You are terribly wrong. Just to let you know, I am a heterosexual man, but have some wonderful men and woman that just happen to be gay (by the way, I hate that word!). Lawyers, physicians, and the list goes on. They are NOT hateful like you, and I ask myself, what did you think about the killing of those "Jews"? People ARE people, and fella, get with the program. Obviously you didn't listen to the Pope 11 months ago. Catch up, and stop being so narrow-minded.

Marriage is a 'national' topic / right; not by state, especially since everyone doesn't agree on who can marry who. I think the overwhelming majority know what is 'natural' when it comes to marriage. But draw a line in the sand and some will not be happy. Even if God stated today for everybody throughout the world to hear, there would still be dissenters. Hopefully, an overwhelming minority ...

The constitution has been in effect since 1789. People need a little time to get used to it.

It would be nice if some people - especially the special ones - would actually read the US CONSTITUTION... its pretty much available anywhere. Pay particular attention to the TENTH AMENDMENT.
