Federal Judge Says Ohio Will Recognize Gay Couples

CINCINNATI (AP) - A federal judge has ordered Ohio authorities to recognize the marriages of gay couples performed in other states.

Judge Timothy Black's ruling on Monday criticized the state's "ongoing arbitrary discrimination on the basis of sexual orientation."

He says the state's marriage recognition bans are unconstitutional and unenforceable.

Black's order doesn't force Ohio to allow gay marriages to be performed in the state.

The state plans to appeal Black's ruling, arguing that Ohio has a sovereign right to ban gay marriage, which voters did overwhelmingly in 2004.

Black delayed deciding whether to stay his ruling pending appeal until attorneys on both sides present their arguments on the issue by the end of Tuesday.

I am formerly from Ohio. It doesn't matter what the voters vote for, if is an "Uncostitutional Law" and discriminates against anyone it should be struck down by the court. Even an amendment to the State Constitution can be deemed "Uncostitutional"

I would remind Ohio's attorney general that The Taliban ruled Ohio ten years ago. That may no longer be the case, according to Judge Black.

DeWine says the people have spoken and they voted to ban gay marriage. The people are not always right. Look how many times the constitution has been amended. Marriage between blacks and whites were banned at one time. Slavery existed because southern states majority whites voted for it. That's why we have a Supreme Court to overthrow unjust legislation which is in violation of the constitution.

A LOT of people who comment here don't seem to have grasped that fundamental purpose of the constitution gpthegreatest..... It makes me weep for the educational system of this country. Whether you AGREE with this or not, it is a FACT and if you don't like the FACT that the constitution PROTECTS MINORITY RIGHTS..... well then, I'm sure you will love the lovely views of North Korea!

People who think this is a religious issue have lost sight of basic rights. In order to get married you need a license, you don't have to have the approval of your church. Also, does your church divorce you when over 50% of marriages end? Marriage is a civil issue and only a religious issue if you choose to make it one.

This is a civil matter about equal rights....under our Constitution they are supposed to be FOR ALL!

Not sure you are always refering to somone as homophobic just because they don't agree with YOU? Also, I noticed you call people morons becuse they don't agree with you. Also the Constitution is not to protect, just the (minority) as you call them. Marriage was set up by God, between a man and a woman, no matter what you think or what you want to believe or how bad you would like it to not be true, so why don't you stop trying to manipulate people by calling every one that disagrees with you a Moron or Homophobe or what ever other non-sense you can come up with.

Can you imagine the mess we would make if we based all of our laws on the Bible...or any religious doctrine. Which doctrine would we use...? I know...let's have a big war and winner can base the laws on their beliefs...not based on what is right and wrong.
