Judge sets November trial for Dzhokhar Tsarnaev in marathon bombing


BOSTON (AP) - A federal judge on Wednesday set a November trial date for Boston Marathon bombing suspect Dzhokhar Tsarnaev over the objections of defense attorneys who said that will not give them enough time to prepare.

Judge George O'Toole Jr. said he believes a Nov. 3 trial is realistic and fair.

Tsarnaev's lawyers had asked for a trial date no earlier than September 2015. Prosecutors, who are seeking the death penalty for Tsarnaev, want the trial this fall.

Tsarnaev has pleaded not guilty to 30 federal counts in the April 15 bombings that killed three people and injured 260 others. Several of those injured in the bombings were in court on Wednesday, but Tsarnaev was not.

Prosecutors allege that the 20-year-old Tsarnaev and his brother, Tamerlan, planted two homemade pressure cooker bombs near the marathon's finish line. Tamerlan Tsarnaev died following a shootout with police a few days later.

Defense attorney Judy Clarke said federal prosecutors have been "sluggish" in responding to requests to turn over evidence and there are a "tremendous amount of logistical hurdles" for the defense to be ready for trial in November.

In particular, Clarke cited 2,000 pieces of physical evidence that are still in the FBI's lab near Washington, D.C., that the defense hasn't been able to examine.

Though I am not a supporter of the death penalty because of so many mistakes during the arrest and prosecution.........I cannot in any way deny why this person should be given any rights at all. Targeting innocent people is a disgusting and cowardly act. Regardless of his age or citizenship he needs to be made an example thereby sending a message to all the other loons floating around this planet!!!!!!!!!!!!!!!!!!!!!!

He's a killer... He needs death penalty now! Should have been done the minute they caught him.
Screwed up justice system.

Because that is how we operate here in the USA. Much as we would like to have swift final justice in this case, doing so without due process, proving to the world that he actually did what he is accused of, is what sets us apart from the rest of the world. Would you have us be like Italy, where the trial of Amanda Knox is a never ending story? Where they will assign guilt to a woman, clear her, and then put that sentence back with interest in an appeal that would never happen here? All based upon the dreams of a sex crazed prosecutor who has been caught framing the innocent before, and with the fogged memories of a homeless man who remembers a bus that didn't even exisg?

Give him his trial; there are a bunch of pretty hanging trees on Boston Common to try him under. Then, slap the horse he is sitting on hard on the haunces. Then appeal. Sound good enough?

Why did the cover photo for the piece use a young, cute picture of this cold blooded terrorist. The media Trayvon Martin Syndrome again. People Mag went so far as to use a picture of a smiling 8 or 10 year old Trayvon, other showed him at 13. That crap touched off lots of racial violence and not a few deaths. The media LOVE America's enemies and love to incite violence to increase ratings for more ad $$. They should have used the Black and White shot above. Tsarnaev has even attracted many young female fans swayed by media photo manipulation of this story. How about starting with some pictures of his bloodied victims.

I am sick of looking at this KILLERS face as if he was a young celebrity. Let's see him placing the bombs, let's see the photos of the innocent people he killed , let's see the victims that are missing their limbs, let's see the devestation that he and his worthless brother caused to innocent men, women and children that did nothing wrong except to be out enjoying an afternoon at a marathon race. Lets refer to this guy as a COLD BLOODED KILLER that he is. !!!

As usual, the MEDIA is making a CULT HERO of this scum by broadcasting his name and face over and over again in the press. When someone commits a crime like this why don't we just call him John Doe and blank out his face. Right now in America there is another teenager dreaming of the day he can be just as famous and popular as this jerk. The Sandy Hook School shooter was an ADMIRER of the Columbine murderers according to his diaries. When will we ever learn?
