Judge sets November trial for Dzhokhar Tsarnaev in marathon bombing

BOSTON (AP) - A federal judge on Wednesday set a November trial date for Boston Marathon bombing suspect Dzhokhar Tsarnaev over the objections of defense attorneys who said that will not give them enough time to prepare.

Judge George O'Toole Jr. said he believes a Nov. 3 trial is realistic and fair.

Tsarnaev's lawyers had asked for a trial date no earlier than September 2015. Prosecutors, who are seeking the death penalty for Tsarnaev, want the trial this fall.

Tsarnaev has pleaded not guilty to 30 federal counts in the April 15 bombings that killed three people and injured 260 others. Several of those injured in the bombings were in court on Wednesday, but Tsarnaev was not.

Prosecutors allege that the 20-year-old Tsarnaev and his brother, Tamerlan, planted two homemade pressure cooker bombs near the marathon's finish line. Tamerlan Tsarnaev died following a shootout with police a few days later.

Defense attorney Judy Clarke said federal prosecutors have been "sluggish" in responding to requests to turn over evidence and there are a "tremendous amount of logistical hurdles" for the defense to be ready for trial in November.

In particular, Clarke cited 2,000 pieces of physical evidence that are still in the FBI's lab near Washington, D.C., that the defense hasn't been able to examine.

There are 2 problems: 1. they didn`t kill him when the opportunity was there. Sort of like the Bin Laden sequence in 2001. I took 10 years to get a Rat that was missed a decade sooner. No time like the present. Don`t put off til tomorrow what you cab do today.

2. Now that the case is in the very public domain of justice and the courts, Atty Clarke makes a reasonable point: there are 2,000 pieces of evidence in a Lab, that must be surrendered in the discovery process. Defense has 8 months to complete the analysis, yet they don`t have the discovery evidence to create a defense.

This brings me back to the first thought, that if you want something done right, you have to do it yourself. The 'Just Us' phase is over and lost, now it`s the Justice phase. The sooner the 'discovery' process is fulfilled with an exchange of evidence, the quicker Americans can have justice served.

As I stated before , you are correct unfortunately. Thats why After Rendition or Interrogation , AL QUEDA fighters should NEVER have been brought to GITMO , but put into a hole in the Desert.

Once they are brought to U.S. Soil ...........

How can the defense attorney miss the fact that the whole world watched this horrific incident go down on TV. CLARKE, get the information needed from Washington, NOW, or they are withholding evidence. You've got to do much better than that. Use your power, and quit making excuses. Unless this is another OJ Simpson case, Dzhakhar and his brother are obviously GUILTY, no questions asked! They intentionally, blew up innocent people with a handmade bomb made by them. The facts are plain and simple. We even saw the bombs in their booksacks. Please dont blow this case. How ignorant can you be? Really?
We should have never let these guys come to our country, and educate them, and other privileges given by us, and have them abuse it with pre-meditated murders.
AMERICA does not deserve this behavior. It was an attack on innocent people in Boston running for a good cause. WHY would they want to do this?
IT IS A PRIVILEGE TO LIVE IN AMERICA. DON'T ABUSE OUR KINDNESS, AND FREEDOM WITH STUPID CRIMES LIKE THIS! YOU MUST PAY FOR SUCH AN AWFUL ACT.
GO HOME, OR GO TO JAIL. SIMPLE.

I think Casey Anthony's attorney violated this one big time!

As for this clown....no death is horrific enough for him!

Thats just what this coward would like....to be sent "home". This murderer accepted US hospitality, was granted a visa to study here and "given" all the rights and freedoms a vistor with a visa deserves. However, he was also under the laws that govern our states and nation. He murdered innocent Americans and should be punished to the full extent of our laws... Giving him the death penalty is the right thing to do..only carry out the sentence as quickly as they did against Timothy McVay. OK, OK,,,if you want to send the bum home...blow off his legs, first, then let him crawl back there on his belly.

I agree with the comment made about sweet, young and innocent pictures of the Tsarnaev brothers
