Dad spent 2.5 years in prison for blogging about his divorce

This Dad Spent 2.5 Years In Prison For Blogging About His Divorce
In 2008, Indiana father Dan Brewington took to his blog to chronicle the difficulties surrounding his divorce proceedings. Frustrated by the lack of answers he received from the closed case file, he posted documents, along with his musings, online, and ended up serving time in prison as a result.

'The custody evaluator wasn't being consistent in his statements,' he told HuffPost Live host Nancy Redd. 'I started questioning it, raising it with the court. Nobody could provide me with a legitimate answer. So what I wound up doing was making a website and a blog. And I put the information on the internet.'

But it was Brewington's criticism of the judge in his case that ended up landing him in prison.

'The prosecutor said, 'you're not allowed to lie.' And so the prosecutor said I called the judge a child abuser. That was one of their biggest complaints. They just started reading statement after statement after statement from the blog saying that the judge was unethical, that he's an evil man, that he's a child abuser for taking children away from their parents. Things of that nature. Just a lot of rhetorical statements.'

When Brewington decided to fight the court for his First Amendment rights instead of accepting a plea bargain, he was sentenced to five years in prison, half of which he served. Since being released from Putnamville Correctional Facility, Brewington has yet to see his two daughters.

'I don't have any contact with them. No phone contact,' he said.

fight for your rights don't give up the court system isn't at fault it's this judge ,they thing they can do and say what ever they want , and you have to do what they say, not true we all have laws that we all must follow and it seems that this isn't true for this judge. your day will come about and you will be able to reach out and get your family your children back into your life. The best of luck for your future.

Great comment! It was thoughtful and kind to the father. I too hope he succeeds in getting his children back into his life!

Brilliant! And all that without wondering why you didn't hear the other side of the story. After he has served 2 1/2 years in jail you just listen to this criminals complaints and believe they have merit. You don't even know what his attorney thinks about it or why the matter, if it was so cut and dried, wasn't reversed on appeal.

The judge needs to be removed from the bench! Obviously he only had one interest in mind...his own! The children will always have a void in their lives. Judges and attorney's only care about the money. In this case the Judge used his power to convict this already hurting man because the Judge's reputation was at stake...good way to set an example. Of course the Judge has immunity in the end. I pray for this man and the loss in both his and his children's life. I am a female and I went through having my family destroyed by the so called "family court system"! It destroys lives...especially the memories your children are robbed of.

Hi Nancy January 27 2014 at 12:26 PM

Since when is disrespecting a judge a law that can be punished with prison time. Sounds like just another clown court in a town with people that are clueless. Title IV D pays you states Federal dollars at a rate of 2 bux for ever one dollar collected in child support. SO for all you stupid moms out there yeah your state is paid big bux to break up your family. If you love your kids stay with your spouse or childs mom or dad dont let this stuff happen. YOUR KIDS ALWAYS SUFFER the worst

it is so typical of divorce court. I have a friend that got a divorce no kids involved she got the house part of his pension and he had to pay her 1,000.00 a month in alimony until she got her inheritance then it would be reduced. in the mean time he went back to court to get a reduction because he was not making the same amount of money and the scum bag judge denied it and told him to move in to a different county further away from his job so he could pay less rent. by the way it cost him 17,000.00 dollars in attorney fees for that motion. then approximately 8 years latter her last parent died and in the divorce decree his alimony had to be reduced . so back to court in front of the same scum bag judge and another 17,000.00 dollars the judge denied it and also made him take out a 150,000.00 life insurance policy on him self and make his ex the beneficiary. so taking a policy of that amount at the age of 55 cost him an extra 125.00 a month in premiums. that judge should be disbarred and put him in jail for the amount of time he caused my best friend mental anguish. because this judge had to be doing something extra for this witch. this man was more than a devoted husband she was the one who wanted the divorce and got everything judges suck when it comes to the man no matter if he was an upstanding guy or a scum bag .

Not all women are like that .
I could never nore would I ever keep our children
from there father. The only way I would do something like that is if he was doing something thatcould get our kids hurt.
And then he could still see them only with me there
I really don't know why women do things like this
and yes there r a lot of them that steps over the line
and have done so for many years.
Yt? Because we gave birth to them doesn't all mean
that we r the ones that should care for them.
I know a lot of dads who r much better at raising
there children than the mom.
so but to say this not all women r like that!!!#!!!!!!!!

There appear to be several steps missing here: of what crime, in what court, was this man convicted? If he was jailed, there had to have been criminal charges filed and tried. Details are important here...

Intimidation of a judge, attempt to obstruct justice (by harassing communications for 18 months to the psychologist), perjury.

all these people seem to forget that yes, you have freedom of speech. but you are also subject to punishment for that speech.

So they put this guy in jail....and who did they take out to make room?
5 years? that's pretty much more than an actual child abuser gets!!!
Ridiculous.
