Woman didn't realize who her neighbor was

Cyndee Phoenix of New Jersey is suing her property developer, Lennar Corp., for failing to mention a "dangerous" neighbor before she bought her condo. "Fox & Friends" says Phoenix claims her neighbor Kevin Potter has made death threats, racist comments, called the police on her and took pictures of guests. Daily Mail says Phoenix hired a bodyguard, but Phoenix claims Potter then began harassing him, too.

Hiring a body guard I think was overkill and was done solely for the purpose of the lawsuit. You have to go elsewhere to read the full story because AOL was too lazy to post it all here, but this guy is a nuisance but nothing he has done would require hiring personal security.

1. He plays his music loud - call the police that disturbing the peace.
2. He stares for long periods of time at the security guard and guests - nothing illegal here.
3. He commented for her to move back to the urban area - noting illegal here.
4. He parks his car in front of her home (he lives across the street) - while this may be an inconvenience - she purchased the home not the street.
5. He spit in her direction - for all we know he was across the street on his porch when he did that - flip him the bird and keep it moving.
6. He followed the guard for 15 minutes - hit the brakes real quick so he can hit you in the back then fall out of the car moaning and screaming then sue the crap out of him for your injuries.
6. He takes pictures of her guest - OK creepy, but nothing illegal about taking pictures of people coming and going in a public place.
7. Alleged Death threats - that is what the police are for.

Apparently when this person was looking at the home, the neighbor came over to make complaints about certain things with his property, and the owners of the development deemed him trying to prevent a sale, and sent a letter to the wife who happens to own the home saying the tactics needs to stop. He is just lashing out over the letter - but hiring a bodyguard is just a bit much for what she described is going on. IMO.

Perhaps there are circumstances you are unaware of. I would not want to live near someone that threatened me or my children (if she has any). Who wants to be uncomfortable in their own home or neighborhood. I certainly would not.

Taking pictures of guests without permission, could be a violation of privacy. What is he using the pictures for? If it's woman and for his pleasure, gross. That's just creepy.

Parking his car in front of her house when he has parking at his house. Starring at her and following the guard for 15 minutes (what, he has nothing better to do???) That's a sign of Harassment!!!

Also, police laws are not for the plaintiff, the laws protect the defendant. Whether it's criminal or a dead beat dad !!!

Wow what a nightmare! What makes a person aggressively paranoid even though you are just minding your own business is anybody's guess. If there is clear and present danger from whack jobs who may be residing next to a property you are considering buying, I think that information should be forthcoming. She should be afraid and take measures to protect herself. It sure is a rotten shame though that should even have to deal with this. In the future if I buy a house or take an apartment, I'm going to want to ask the neighbor's about the crazies or the perverts. With my luck I'll get the crazy pervert who says that I should move in, no problems! LOL

She 'had' to hire a bodyguard? Yeah, right. Maybe she should have just bought a handgun and taken a self-defense class and gun training, or just moved someplace else. Those are the maximum expenses she should be paid for, not for hiring a guard and who knows what else.

I had a nut job of a neighbor from hell. His harassment got so bad that the police knew Scott P. By name and also warned him to stop harassing us. We ended up selling our home and moving but had to disclose this ahole to the new owners. He then started harassing another neighbor. I hope that some day he harasses the wrong person and gets what he so deserves!
